55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to space utilization and online enrollment requirements
88 for the issuance of revenue bonds by certain public institutions of
99 higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 55.13, Education Code, is amended by
1212 adding Subsections (d), (e), and (f) to read as follows:
1313 (d) Notwithstanding any other provision of this chapter or
1414 other law, the board of a general academic teaching institution
1515 other than a public state college, or the Texas Public Finance
1616 Authority on behalf of that institution, if applicable, may not
1717 under this chapter issue bonds payable from revenue funds of the
1818 institution unless the institution has satisfied the standards
1919 prescribed by the Texas Higher Education Coordinating Board for:
2020 (1) space utilization in educational and general
2121 buildings and facilities at the institution; and
2222 (2) the percentage of students enrolled in the
2323 institution who enroll in online courses offered by the
2424 institution.
2525 (e) The Texas Higher Education Coordinating Board may adopt
2626 rules for the administration of Subsection (d).
2727 (f) In this section, "educational and general buildings and
2828 facilities," "general academic teaching institution," and "public
2929 state college" have the meanings assigned by Section 61.003.
3030 SECTION 2. The change in law made by this Act does not
3131 affect the validity of any bonds the issuance of which was
3232 authorized before the effective date of this Act.
3333 SECTION 3. This Act takes effect September 1, 2015.
