| 8 | 8 | | for the issuance of revenue bonds by certain public institutions of |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 55.13, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsections (d), (e), and (f) to read as follows: |
|---|
| 13 | 13 | | (d) Notwithstanding any other provision of this chapter or |
|---|
| 14 | 14 | | other law, the board of a general academic teaching institution |
|---|
| 15 | 15 | | other than a public state college, or the Texas Public Finance |
|---|
| 16 | 16 | | Authority on behalf of that institution, if applicable, may not |
|---|
| 17 | 17 | | under this chapter issue bonds payable from revenue funds of the |
|---|
| 18 | 18 | | institution unless the institution has satisfied the standards |
|---|
| 19 | 19 | | prescribed by the Texas Higher Education Coordinating Board for: |
|---|
| 20 | 20 | | (1) space utilization in educational and general |
|---|
| 21 | 21 | | buildings and facilities at the institution; and |
|---|
| 22 | 22 | | (2) the percentage of students enrolled in the |
|---|
| 23 | 23 | | institution who enroll in online courses offered by the |
|---|
| 24 | 24 | | institution. |
|---|
| 25 | 25 | | (e) The Texas Higher Education Coordinating Board may adopt |
|---|
| 26 | 26 | | rules for the administration of Subsection (d). |
|---|
| 27 | 27 | | (f) In this section, "educational and general buildings and |
|---|
| 28 | 28 | | facilities," "general academic teaching institution," and "public |
|---|
| 29 | 29 | | state college" have the meanings assigned by Section 61.003. |
|---|
| 30 | 30 | | SECTION 2. The change in law made by this Act does not |
|---|
| 31 | 31 | | affect the validity of any bonds the issuance of which was |
|---|
| 32 | 32 | | authorized before the effective date of this Act. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2015. |
