55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exempting the procurement of services for victims of
88 family violence from competitive bidding requirements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 2155, Government Code, is
1111 amended by adding Section 2155.1443 to read as follows:
1212 Sec. 2155.1443. EXEMPTION FOR SERVICES PROVIDED BY FAMILY
1313 VIOLENCE CENTER OR FAMILY VIOLENCE SPECIAL PROJECT. (a) The
1414 competitive bidding provisions of this chapter do not apply to a
1515 state purchase of services that meets the specifications for
1616 services prescribed by Section 51.005, Human Resources Code, and
1717 provided by:
1818 (1) a family violence center, as that term is defined
1919 by Section 51.002, Human Resources Code; or
2020 (2) a family violence special project, as that term is
2121 defined by Section 51.002, Human Resources Code.
2222 (b) The Health and Human Services Commission shall procure
2323 services for victims of family violence as provided by Chapter 51,
2424 Human Resources Code, in consultation with a statewide family
2525 violence organization and in a manner consistent with the plan for
2626 delivering family violence services under Section 51.0021, Human
2727 Resources Code.
2828 SECTION 2. The heading to Section 51.004, Human Resources
2929 Code, is amended to read as follows:
3030 Sec. 51.004. CONTRACT ELIGIBILITY [BIDS].
3131 SECTION 3. Section 51.004(e), Human Resources Code, is
3232 repealed.
3333 SECTION 4. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2015.
