| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 2155, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2155.1443 to read as follows: |
|---|
| 12 | 12 | | Sec. 2155.1443. EXEMPTION FOR SERVICES PROVIDED BY FAMILY |
|---|
| 13 | 13 | | VIOLENCE CENTER OR FAMILY VIOLENCE SPECIAL PROJECT. (a) The |
|---|
| 14 | 14 | | competitive bidding provisions of this chapter do not apply to a |
|---|
| 15 | 15 | | state purchase of services that meets the specifications for |
|---|
| 16 | 16 | | services prescribed by Section 51.005, Human Resources Code, and |
|---|
| 17 | 17 | | provided by: |
|---|
| 18 | 18 | | (1) a family violence center, as that term is defined |
|---|
| 19 | 19 | | by Section 51.002, Human Resources Code; or |
|---|
| 20 | 20 | | (2) a family violence special project, as that term is |
|---|
| 21 | 21 | | defined by Section 51.002, Human Resources Code. |
|---|
| 22 | 22 | | (b) The Health and Human Services Commission shall procure |
|---|
| 23 | 23 | | services for victims of family violence as provided by Chapter 51, |
|---|
| 24 | 24 | | Human Resources Code, in consultation with a statewide family |
|---|
| 25 | 25 | | violence organization and in a manner consistent with the plan for |
|---|
| 26 | 26 | | delivering family violence services under Section 51.0021, Human |
|---|
| 27 | 27 | | Resources Code. |
|---|
| 28 | 28 | | SECTION 2. The heading to Section 51.004, Human Resources |
|---|
| 29 | 29 | | Code, is amended to read as follows: |
|---|
| 30 | 30 | | Sec. 51.004. CONTRACT ELIGIBILITY [BIDS]. |
|---|
| 31 | 31 | | SECTION 3. Section 51.004(e), Human Resources Code, is |
|---|
| 32 | 32 | | repealed. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2015. |
