77 relating to reimbursement under preferred provider benefit plans
88 for services provided by licensed podiatrists.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1301.062, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 1301.062. PREFERRED PROVIDER CONTRACTS BETWEEN
1313 INSURERS AND PODIATRISTS. A preferred provider contract between an
1414 insurer and a podiatrist licensed by the Texas State Board of
1515 Podiatric Medical Examiners must provide that:
1616 (1) the podiatrist may request a copy of the coding
1717 guidelines and payment schedules applicable to the compensation
1818 that the podiatrist will receive under the contract for services;
1919 (2) the insurer shall provide a copy of the coding
2020 guidelines and payment schedules not later than the 30th day after
2121 the date of the podiatrist's request;
2222 (3) the insurer may not unilaterally make material
2323 retroactive revisions to the coding guidelines and payment
2424 schedules; [and]
2525 (4) the podiatrist may, practicing within the scope of
2626 the law regulating podiatry, furnish x-rays and nonprefabricated
2727 orthotics covered by the health insurance policy; and
2828 (5) the methodology used to compute the amount of
2929 payment or reimbursement for services or procedures covered by the
3030 contract is the same as the methodology used to compute the amount
3131 of payment or reimbursement when the services or procedures are
3232 provided by a physician, including an osteopathic physician.
3333 SECTION 2. The change in law made by this Act applies only
3434 to a preferred provider contract entered into or renewed on or after
3535 January 1, 2016. A contract entered into or renewed before January
3636 1, 2016, is governed by the law applicable to the contract
3737 immediately before the effective date of this Act, and that law is
3838 continued in effect for that purpose.
3939 SECTION 3. This Act takes effect September 1, 2015.
