147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Subtitle F, Title 6, Special District Local Laws
169 Code, is amended by adding Chapter 8500 to read as follows:
1710 CHAPTER 8500. WILLIAMSON COUNTY MUNICIPAL
1811 UTILITY DISTRICT NO. 23
1912 SUBCHAPTER A. GENERAL PROVISIONS
2013 Sec. 8500.001. DEFINITION. In this chapter, "district"
2114 means the Williamson County Municipal Utility District No. 23.
2215 Sec. 8500.002. NATURE AND PURPOSES OF DISTRICT. (a) The
2316 district is a municipal utility district created under Section 59,
2417 Article XVI, Texas Constitution.
2518 (b) The district is created to accomplish the purposes of:
2619 (1) a municipal utility district as provided by
2720 general law and Section 59, Article XVI, Texas Constitution; and
2821 (2) Section 52, Article III, Texas Constitution, that
2922 relate to the construction, acquisition, improvement, operation,
3023 or maintenance of macadamized, graveled, or paved roads, or
3124 improvements, including storm drainage, in aid of those roads.
3225 SUBCHAPTER B. POWERS AND DUTIES
3326 Sec. 8500.051. GENERAL POWERS AND DUTIES. The district has
3427 the powers and duties necessary to accomplish the purposes for
3528 which the district is created.
3629 Sec. 8500.052. MUNICIPAL UTILITY DISTRICT POWERS AND
3730 DUTIES. The district has the powers and duties provided by the
3831 general law of this state, including Chapters 49 and 54, Water Code,
3932 applicable to municipal utility districts created under Section 59,
4033 Article XVI, Texas Constitution.
4134 Sec. 8500.053. AUTHORITY FOR ROAD PROJECTS. Under Section
4235 52, Article III, Texas Constitution, the district may design,
4336 acquire, construct, finance, issue bonds for, improve, operate,
4437 maintain, and convey to this state, a county, or a municipality for
4538 operation and maintenance macadamized, graveled, or paved roads, or
4639 improvements, including storm drainage, in aid of those roads.
4740 Sec. 8500.054. ROAD STANDARDS AND REQUIREMENTS. (a) A road
4841 project must meet all applicable construction standards, zoning and
4942 subdivision requirements, and regulations of each municipality in
5043 whose corporate limits or extraterritorial jurisdiction the road
5144 project is located.
5245 (b) If a road project is not located in the corporate limits
5346 or extraterritorial jurisdiction of a municipality, the road
5447 project must meet all applicable construction standards,
5548 subdivision requirements, and regulations of each county in which
5649 the road project is located.
5750 (c) If the state will maintain and operate the road, the
5851 Texas Transportation Commission must approve the plans and
5952 specifications of the road project.
6053 SUBCHAPTER C. BONDS AND OTHER OBLIGATIONS
6154 Sec. 8500.101. AUTHORITY TO ISSUE BONDS AND OTHER
6255 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds or
6356 other obligations payable wholly or partly from ad valorem taxes,
6457 impact fees, revenue, contract payments, grants, or other district
6558 money, or any combination of those sources, to pay for a road
6659 project authorized by Section 8500.053.
6760 (b) The district may not issue bonds payable from ad valorem
6861 taxes to finance a road project unless the issuance is approved by a
6962 vote of a two-thirds majority of the district voters voting at an
7063 election held for that purpose.
7164 (c) At the time of issuance, the total principal amount of
7265 bonds or other obligations issued or incurred to finance road
7366 projects and payable from ad valorem taxes may not exceed
7467 one-fourth of the assessed value of the real property in the
7568 district.
7669 Sec. 8500.102. TAXES FOR BONDS. At the time the district
7770 issues bonds payable wholly or partly from ad valorem taxes, the
7871 board of directors of the district shall provide for the annual
7972 imposition of a continuing direct ad valorem tax, without limit as
8073 to rate or amount, while all or part of the bonds are outstanding as
8174 required and in the manner provided by Sections 54.601 and 54.602,
8275 Water Code.
8376 SECTION 2. The Williamson County Municipal Utility District
8477 No. 23 retains all rights, powers, privileges, authority, duties,
8578 and functions that it had before the effective date of this Act.
8679 SECTION 3. (a) The legislature validates and confirms all
8780 governmental acts and proceedings of the Williamson County
8881 Municipal Utility District No. 23 that were taken before the
8982 effective date of this Act.
9083 (b) This section does not apply to any matter that on the
9184 effective date of this Act:
9285 (1) is involved in litigation if the litigation
9386 ultimately results in the matter being held invalid by a final court
9487 judgment; or
9588 (2) has been held invalid by a final court judgment.
9689 SECTION 4. (a) The legal notice of the intention to
9790 introduce this Act, setting forth the general substance of this
9891 Act, has been published as provided by law, and the notice and a
9992 copy of this Act have been furnished to all persons, agencies,
10093 officials, or entities to which they are required to be furnished
10194 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
10295 Government Code.
10396 (b) The governor, one of the required recipients, has
10497 submitted the notice and Act to the Texas Commission on
10598 Environmental Quality.
10699 (c) The Texas Commission on Environmental Quality has filed
107100 its recommendations relating to this Act with the governor, the
108101 lieutenant governor, and the speaker of the house of
109102 representatives within the required time.
110103 (d) All requirements of the constitution and laws of this
111104 state and the rules and procedures of the legislature with respect
112105 to the notice, introduction, and passage of this Act are fulfilled
113106 and accomplished.
114107 SECTION 5. This Act takes effect immediately if it receives
115108 a vote of two-thirds of all the members elected to each house, as
116109 provided by Section 39, Article III, Texas Constitution. If this
117110 Act does not receive the vote necessary for immediate effect, this
118111 Act takes effect September 1, 2015.
