66 AN ACT
77 relating to creation of entities affiliated with a church organized
88 as a nonprofit corporation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 22, Business Organizations
1111 Code, is amended by adding Section 22.236 to read as follows:
1212 Sec. 22.236. INTEGRATED AUXILIARIES OF CHURCHES. (a) In
1313 this section, "integrated auxiliary of a church" means an
1414 organization described by Section 501(c)(3), Internal Revenue
1515 Code, that:
1616 (1) is affiliated with a church or a convention or
1717 association of churches;
1818 (2) is not a church or a convention or association of
1919 churches; and
2020 (3) either:
2121 (A) receives financial support primarily from
2222 internal church sources instead of from public or governmental
2323 sources; or
2424 (B) is a men's or women's organization, a
2525 seminary, a mission society, or a youth group.
2626 (b) The board of directors of a corporation that is a church
2727 must give prior approval for the creation of any integrated
2828 auxiliary of the church.
2929 SECTION 2. This Act applies only to an integrated auxiliary
3030 of a church created on or after September 1, 2015. An integrated
3131 auxiliary created before the effective date of this Act is governed
3232 by the law in effect immediately before the effective date of this
3333 Act, and the former law is continued in effect for that purpose.
3434 SECTION 3. This Act takes effect September 1, 2015.
