| 12 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 12 | | SECTION 1. Section 508.145, Government Code, is amended by |
|---|
| 14 | 13 | | adding Subsection (e-1) to read as follows: |
|---|
| 15 | 14 | | (e-1) An inmate serving a sentence for an offense under |
|---|
| 16 | 15 | | Section 43.26, Penal Code, is not eligible for release on parole |
|---|
| 17 | 16 | | until the inmate's actual calendar time served, without |
|---|
| 18 | 17 | | consideration of good conduct time, equals one-half of the inmate's |
|---|
| 19 | 18 | | sentence. |

| 20 | 19 | | SECTION 2. Sections 43.26(d) and (g), Penal Code, are |
|---|
| 21 | 20 | | amended to read as follows: |
|---|
| 22 | 21 | | (d) An offense under Subsection (a) is a felony of the |
|---|
| 23 | 22 | | second [third] degree. |
|---|
| 24 | 23 | | (g) An offense under Subsection (e) is a felony of the first |
|---|
| 25 | 24 | | [second] degree. |
|---|
| 26 | 25 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 27 | 26 | | to an offense committed on or after the effective date of this Act. |
|---|
| 28 | 27 | | An offense committed before the effective date of this Act is |
|---|
| 29 | 28 | | governed by the law in effect on the date the offense was committed, |
|---|
| 30 | 29 | | and the former law is continued in effect for that purpose. For |
|---|
| 31 | 30 | | purposes of this section, an offense was committed before the |
|---|
| 32 | 31 | | effective date of this Act if any element of the offense occurred |
|---|
| 33 | 32 | | before that date. |
|---|
| 34 | 33 | | SECTION 4. This Act takes effect September 1, 2015. |
