87 AN ACT
98 relating to increasing the punishment for the offense of possession
109 or promotion of child pornography; changing the eligibility for
1110 parole.
1211 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1312 SECTION 1. Section 508.145, Government Code, is amended by
1413 adding Subsection (e-1) to read as follows:
1514 (e-1) An inmate serving a sentence for an offense under
1615 Section 43.26, Penal Code, is not eligible for release on parole
1716 until the inmate's actual calendar time served, without
1817 consideration of good conduct time, equals one-half of the inmate's
1918 sentence.
2019 SECTION 2. Sections 43.26(d) and (g), Penal Code, are
2120 amended to read as follows:
2221 (d) An offense under Subsection (a) is a felony of the
2322 second [third] degree.
2423 (g) An offense under Subsection (e) is a felony of the first
2524 [second] degree.
2625 SECTION 3. The change in law made by this Act applies only
2726 to an offense committed on or after the effective date of this Act.
2827 An offense committed before the effective date of this Act is
2928 governed by the law in effect on the date the offense was committed,
3029 and the former law is continued in effect for that purpose. For
3130 purposes of this section, an offense was committed before the
3231 effective date of this Act if any element of the offense occurred
3332 before that date.
3433 SECTION 4. This Act takes effect September 1, 2015.
