125 relating to the composition of the Texas Military Preparedness
136 Commission.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Section 436.051(a), Government Code, is amended
169 to read as follows:
1710 (a) The commission is composed of:
1811 (1) 13 public members, appointed by the governor; and
1912 (2) the following ex officio members:
2013 (A) the chair of the committee of the Texas House
2114 of Representatives that has primary jurisdiction of matters
2215 concerning defense affairs and military affairs; [and]
2316 (B) the chair of the committee of the Texas
2417 Senate that has primary jurisdiction of matters concerning defense
2518 affairs and military affairs; and
2619 (C) the adjutant general.
2720 SECTION 2. The heading to Section 436.052, Government Code,
2821 is amended to read as follows:
2922 Sec. 436.052. TERMS AND OFFICERS; EX OFFICIO MEMBERS;
3023 DESIGNATION OF REPRESENTATIVE.
3124 SECTION 3. Section 436.052, Government Code, is amended by
3225 amending Subsection (a) and adding Subsection (a-1) to read as
3326 follows:
3427 (a) The 13 public members of the commission serve staggered
3528 terms of six years with the terms of four or five members expiring
3629 February 1 of each odd-numbered year. A legislative member vacates
3730 the person's position on the commission if the person ceases to be
3831 the chair of the applicable legislative committee. The ex officio
3932 member of the commission described by Section 436.051(a)(2)(C)
4033 vacates the person's position on the commission if the person
4134 ceases to hold the position that qualifies the person for service on
4235 the commission.
4336 (a-1) The ex officio member of the commission described by
4437 Section 436.051(a)(2)(C) may designate a representative to serve on
4538 the commission in the member's absence. A representative
4639 designated under this subsection must be an officer or employee of
4740 the state agency the ex officio member serves.
4841 SECTION 4. Section 436.053, Government Code, is amended to
4942 read as follows:
5043 Sec. 436.053. COMPENSATION AND EXPENSES. (a) A public
5144 member of the commission is not entitled to compensation but is
5245 entitled to reimbursement, from commission funds, for the travel
5346 expenses incurred by the member while conducting the business of
5447 the commission, as provided by the General Appropriations Act.
5548 (b) The entitlement of a legislative member to compensation
5649 or reimbursement for travel expenses is governed by the law
5750 applying to the member's service in that underlying position, and
5851 any payments to the member shall be made from the appropriate funds
5952 of the applicable house of the legislature.
6053 (c) The entitlement of the ex officio member described by
6154 Section 436.051(a)(2)(C) to compensation or to reimbursement for
6255 travel expenses incurred while transacting commission business is
6356 governed by the law that applies to the member's service in that
6457 underlying position, and any payment to the member for either
6558 purpose must be made from money that may be used for the purpose and
6659 is available to the state agency that the member serves in that
6760 underlying position.
6861 SECTION 5. This Act takes effect September 1, 2015.
