14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 8 | | SECTION 1. Section 436.051(a), Government Code, is amended |
---|
16 | 9 | | to read as follows: |
---|
17 | 10 | | (a) The commission is composed of: |
---|
18 | 11 | | (1) 13 public members, appointed by the governor; and |
---|
19 | 12 | | (2) the following ex officio members: |
---|
20 | 13 | | (A) the chair of the committee of the Texas House |
---|
21 | 14 | | of Representatives that has primary jurisdiction of matters |
---|
22 | 15 | | concerning defense affairs and military affairs; [and] |
---|
23 | 16 | | (B) the chair of the committee of the Texas |
---|
24 | 17 | | Senate that has primary jurisdiction of matters concerning defense |
---|
25 | 18 | | affairs and military affairs; and |
---|
26 | 19 | | (C) the adjutant general. |

27 | 20 | | SECTION 2. The heading to Section 436.052, Government Code, |
---|
28 | 21 | | is amended to read as follows: |
---|
29 | 22 | | Sec. 436.052. TERMS AND OFFICERS; EX OFFICIO MEMBERS; |
---|
30 | 23 | | DESIGNATION OF REPRESENTATIVE. |
---|
31 | 24 | | SECTION 3. Section 436.052, Government Code, is amended by |
---|
32 | 25 | | amending Subsection (a) and adding Subsection (a-1) to read as |
---|
33 | 26 | | follows: |
---|
34 | 27 | | (a) The 13 public members of the commission serve staggered |
---|
35 | 28 | | terms of six years with the terms of four or five members expiring |
---|
36 | 29 | | February 1 of each odd-numbered year. A legislative member vacates |
---|
37 | 30 | | the person's position on the commission if the person ceases to be |
---|
38 | 31 | | the chair of the applicable legislative committee. The ex officio |
---|
39 | 32 | | member of the commission described by Section 436.051(a)(2)(C) |
---|
40 | 33 | | vacates the person's position on the commission if the person |
---|
41 | 34 | | ceases to hold the position that qualifies the person for service on |
---|
42 | 35 | | the commission. |
---|
43 | 36 | | (a-1) The ex officio member of the commission described by |
---|
44 | 37 | | Section 436.051(a)(2)(C) may designate a representative to serve on |
---|
45 | 38 | | the commission in the member's absence. A representative |
---|
46 | 39 | | designated under this subsection must be an officer or employee of |
---|
47 | 40 | | the state agency the ex officio member serves. |

48 | 41 | | SECTION 4. Section 436.053, Government Code, is amended to |
---|
49 | 42 | | read as follows: |
---|
50 | 43 | | Sec. 436.053. COMPENSATION AND EXPENSES. (a) A public |
---|
51 | 44 | | member of the commission is not entitled to compensation but is |
---|
52 | 45 | | entitled to reimbursement, from commission funds, for the travel |
---|
53 | 46 | | expenses incurred by the member while conducting the business of |
---|
54 | 47 | | the commission, as provided by the General Appropriations Act. |
---|
55 | 48 | | (b) The entitlement of a legislative member to compensation |
---|
56 | 49 | | or reimbursement for travel expenses is governed by the law |
---|
57 | 50 | | applying to the member's service in that underlying position, and |
---|
58 | 51 | | any payments to the member shall be made from the appropriate funds |
---|
59 | 52 | | of the applicable house of the legislature. |
---|
60 | 53 | | (c) The entitlement of the ex officio member described by |
---|
61 | 54 | | Section 436.051(a)(2)(C) to compensation or to reimbursement for |
---|
62 | 55 | | travel expenses incurred while transacting commission business is |
---|
63 | 56 | | governed by the law that applies to the member's service in that |
---|
64 | 57 | | underlying position, and any payment to the member for either |
---|
65 | 58 | | purpose must be made from money that may be used for the purpose and |
---|
66 | 59 | | is available to the state agency that the member serves in that |
---|
67 | 60 | | underlying position. |
---|
68 | 61 | | SECTION 5. This Act takes effect September 1, 2015. |
