66 AN ACT
77 relating to reports regarding the use of restraints on pregnant
88 prisoners in county jails.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 511, Government Code, is amended by
1111 adding Section 511.0103 to read as follows:
1212 Sec. 511.0103. REPORT REGARDING RESTRAINT OF PREGNANT
1313 PRISONER. (a) Not later than February 1 of each year, each county
1414 jail shall submit to the commission a report regarding the jail's
1515 use, during the preceding calendar year, of any type of restraints
1616 to control or restrict the movement of a prisoner, including a limb
1717 or other part of the prisoner, who:
1818 (1) is pregnant; or
1919 (2) gave birth three or fewer days before the use of
2020 the restraints.
2121 (b) The report must include the circumstances of each use of
2222 restraints, including:
2323 (1) the specific type of restraints used;
2424 (2) what activity the prisoner was engaged in
2525 immediately before being restrained;
2626 (3) whether the prisoner was restrained during or
2727 after delivery; and
2828 (4) the reasons supporting the determination to use
2929 the restraints, a description of the process by which the
3030 determination was made, and the name and title of the person or
3131 persons making the determination.
3232 (c) The commission shall prescribe a form for the report
3333 required for this section.
3434 SECTION 2. Not later than December 1, 2015, the Commission
3535 on Jail Standards shall adopt rules to implement Section 511.0103,
3636 Government Code, as added by this Act.
3737 SECTION 3. This Act takes effect September 1, 2015.
