| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 511, Government Code, is amended by |
|---|
| 11 | 11 | | adding Section 511.0103 to read as follows: |
|---|
| 12 | 12 | | Sec. 511.0103. REPORT REGARDING RESTRAINT OF PREGNANT |
|---|
| 13 | 13 | | PRISONER. (a) Not later than February 1 of each year, each county |
|---|
| 14 | 14 | | jail shall submit to the commission a report regarding the jail's |
|---|
| 15 | 15 | | use, during the preceding calendar year, of any type of restraints |
|---|
| 16 | 16 | | to control or restrict the movement of a prisoner, including a limb |
|---|
| 17 | 17 | | or other part of the prisoner, who: |
|---|
| 18 | 18 | | (1) is pregnant; or |
|---|
| 19 | 19 | | (2) gave birth three or fewer days before the use of |
|---|
| 20 | 20 | | the restraints. |
|---|
| 21 | 21 | | (b) The report must include the circumstances of each use of |
|---|
| 22 | 22 | | restraints, including: |
|---|
| 23 | 23 | | (1) the specific type of restraints used; |
|---|
| 24 | 24 | | (2) what activity the prisoner was engaged in |
|---|
| 25 | 25 | | immediately before being restrained; |
|---|
| 26 | 26 | | (3) whether the prisoner was restrained during or |
|---|
| 27 | 27 | | after delivery; and |
|---|
| 28 | 28 | | (4) the reasons supporting the determination to use |
|---|
| 29 | 29 | | the restraints, a description of the process by which the |
|---|
| 30 | 30 | | determination was made, and the name and title of the person or |
|---|
| 31 | 31 | | persons making the determination. |
|---|
| 32 | 32 | | (c) The commission shall prescribe a form for the report |
|---|
| 33 | 33 | | required for this section. |
|---|
| 34 | 34 | | SECTION 2. Not later than December 1, 2015, the Commission |
|---|
| 35 | 35 | | on Jail Standards shall adopt rules to implement Section 511.0103, |
|---|
| 36 | 36 | | Government Code, as added by this Act. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2015. |
