55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the repeal of the junior priority of a water right
88 authorizing a transfer of water from one river basin in this state
99 to another river basin in this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 11.085(s) and (t), Water Code, are
1212 repealed.
1313 SECTION 2. (a) This Act applies only to an application for
1414 a water right or an amendment to a permit, certified filing, or
1515 certificate of adjudication authorizing an interbasin transfer of
1616 water that is accepted for filing on or after the effective date of
1717 this Act.
1818 (b) An application for a water right or an amendment to a
1919 permit, certified filing, or certificate of adjudication
2020 authorizing an interbasin transfer of water that is accepted for
2121 filing before the effective date of this Act is governed by the law
2222 in effect at the time the application is accepted for filing, and
2323 the former law is continued in effect for that purpose.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2015.
