| 7 | 7 | | relating to the repeal of the junior priority of a water right |
|---|
| 8 | 8 | | authorizing a transfer of water from one river basin in this state |
|---|
| 9 | 9 | | to another river basin in this state. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 11.085(s) and (t), Water Code, are |
|---|
| 12 | 12 | | repealed. |
|---|
| 13 | 13 | | SECTION 2. (a) This Act applies only to an application for |
|---|
| 14 | 14 | | a water right or an amendment to a permit, certified filing, or |
|---|
| 15 | 15 | | certificate of adjudication authorizing an interbasin transfer of |
|---|
| 16 | 16 | | water that is accepted for filing on or after the effective date of |
|---|
| 17 | 17 | | this Act. |
|---|
| 18 | 18 | | (b) An application for a water right or an amendment to a |
|---|
| 19 | 19 | | permit, certified filing, or certificate of adjudication |
|---|
| 20 | 20 | | authorizing an interbasin transfer of water that is accepted for |
|---|
| 21 | 21 | | filing before the effective date of this Act is governed by the law |
|---|
| 22 | 22 | | in effect at the time the application is accepted for filing, and |
|---|
| 23 | 23 | | the former law is continued in effect for that purpose. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2015. |
|---|
