66 AN ACT
77 relating to the establishment of an electronic information and
88 application system for state and local incentives for economic
99 development purposes.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle G, Title 10, Government Code, is
1212 amended by adding Chapter 2301 to read as follows:
1313 CHAPTER 2301. ELECTRONIC ECONOMIC DEVELOPMENT INCENTIVES
1414 INFORMATION AND APPLICATION SYSTEM
1515 Sec. 2301.001. DEFINITIONS. In this chapter:
1616 (1) "Department," "electronic government project,"
1717 "local government," and "state electronic Internet portal" have the
1818 meanings assigned by Section 2054.003.
1919 (2) "Monetary incentive" means a grant, loan, or other
2020 form of monetary incentive paid from state or local government
2121 revenues that a business entity may receive in exchange for or as a
2222 result of conducting an activity with an economic development
2323 purpose.
2424 (3) "State agency" means a department, commission,
2525 board, office, council, authority, or other state agency in the
2626 executive branch of state government.
2727 (4) "Tax incentive" means any exemption, deduction,
2828 credit, exclusion, waiver, rebate, discount, deferral, or other
2929 abatement or reduction of state or local government tax liability
3030 of a business entity that the business entity may receive in
3131 exchange for or as a result of conducting an activity with an
3232 economic development purpose.
3333 Sec. 2301.002. ESTABLISHMENT OF PROJECT. The department
3434 shall establish an electronic government project to develop an
3535 Internet website accessible through the state electronic Internet
3636 portal that:
3737 (1) provides a single location that a business entity
3838 considering relocating to or expanding in this state may use to
3939 receive information relating to state and local government monetary
4040 and tax incentives for which the entity may be qualified;
4141 (2) includes an interactive tool that allows a
4242 business entity to:
4343 (A) determine whether the entity may be eligible
4444 for any state or local government monetary or tax incentive in this
4545 state; and
4646 (B) receive an estimate of the state and local
4747 government monetary and tax incentives for which the entity may be
4848 eligible;
4949 (3) allows, when feasible, the business entity to fill
5050 out one application for all state and local government monetary and
5151 tax incentives for which the entity may be eligible; and
5252 (4) allows, when feasible, for the application to be
5353 submitted to each state agency or local government that offers the
5454 monetary or tax incentive for which the business entity may be
5555 eligible.
5656 Sec. 2301.003. ESTABLISHING AND OPERATING PROJECT;
5757 COORDINATION. In establishing and operating the electronic
5858 government project under this chapter, the department, in
5959 coordination with the Texas Economic Development and Tourism Office
6060 and the comptroller, and with the assistance of officials of local
6161 governments, shall direct, coordinate, and assist state agencies
6262 and local governments in establishing and using:
6363 (1) a common electronic application and reporting
6464 system, including:
6565 (A) a standard format for announcing monetary and
6666 tax incentive opportunities;
6767 (B) standard data elements for use in creating
6868 monetary and tax incentive opportunity announcement summaries,
6969 including existing monetary and tax incentives and search
7070 functions; and
7171 (C) a common application form for a person to use
7272 in applying for a monetary or tax incentive from multiple state
7373 agencies and local governments; and
7474 (2) a process for:
7575 (A) improving interagency and intergovernmental
7676 coordination of information collection and sharing of data relating
7777 to monetary and tax incentives; and
7878 (B) improving the timeliness, completeness, and
7979 quality of applications received by a state agency or local
8080 government for monetary and tax incentives.
8181 SECTION 2. This Act takes effect September 1, 2015.
