55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the portion of designated tuition set aside to provide
88 student financial assistance at institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 56.011 and 56.012, Education Code, are
1111 amended to read as follows:
1212 Sec. 56.011. RESIDENT UNDERGRADUATE STUDENT ASSISTANCE.
1313 (a) The governing board of each institution of higher education may
1414 [shall] cause to be set aside not more [less] than 15 [20] percent
1515 of any amount of tuition charged to a resident undergraduate
1616 student under Section 54.0513 in excess of $46 per semester credit
1717 hour. The funds set aside under this section by an institution
1818 shall be used to provide financial assistance for resident
1919 undergraduate students enrolled in the institution.
2020 (b) From the funds set aside by an institution under this
2121 section, the institution shall first fund any tuition and fee
2222 exemptions required under Section 54.341 for veterans and other
2323 military personnel and their dependents and surviving family
2424 members enrolled as undergraduate students at the institution.
2525 (c) To be eligible for assistance from any remaining funds
2626 available under this section after the use of those funds required
2727 by Subsection (b), a student must establish financial need in
2828 accordance with rules and procedures established by the Texas
2929 Higher Education Coordinating Board. Priority shall be given to
3030 students who meet the coordinating board definition of financial
3131 need and whose cost for tuition and required fees is not met through
3232 other non-loan financial assistance programs.
3333 (d) [(c)] The financial assistance provided under
3434 Subsection (c) [this section] may include grants, scholarships,
3535 work-study programs, student loans, and student loan repayment
3636 assistance.
3737 Sec. 56.012. RESIDENT GRADUATE STUDENT ASSISTANCE. (a)
3838 The governing board of each institution of higher education may
3939 [shall] cause to be set aside not more [less] than 15 percent of any
4040 amount of tuition charged to a resident student enrolled in a
4141 graduate or professional degree program under Section 54.0513 in
4242 excess of $46 per semester credit hour. The funds set aside under
4343 this section by an institution shall be used to provide financial
4444 assistance for resident students enrolled in graduate and
4545 professional degree programs at the institution.
4646 (b) From the funds set aside by an institution under this
4747 section, the institution shall first fund any tuition and fee
4848 exemptions required under Section 54.341 for veterans and other
4949 military personnel and their dependents and surviving family
5050 members enrolled in graduate and professional degree programs at
5151 the institution.
5252 (c) To be eligible for assistance from any remaining funds
5353 available under this section after the use of those funds required
5454 by Subsection (b), a student must establish financial need in
5555 accordance with rules and procedures established by the Texas
5656 Higher Education Coordinating Board. Priority shall be given to
5757 students who meet the coordinating board definition of financial
5858 need and whose cost for tuition and required fees is not met through
5959 other non-loan financial assistance programs.
6060 (d) [(c)] The financial assistance provided under
6161 Subsection (c) [this section] may include grants, scholarships,
6262 work-study programs, student loans, and student loan repayment
6363 assistance.
6464 SECTION 2. Section 56.014(a), Education Code, is amended to
6565 read as follows:
6666 (a) An institution of higher education that sets [is
6767 required by this subchapter to set] aside a portion of a student's
6868 tuition payments to provide financial assistance for students
6969 enrolled in the institution under this subchapter shall provide to
7070 each student of the institution who pays tuition from which a
7171 portion is [required to be] set aside for that purpose a notice
7272 regarding the specific amount that is [required to be] set aside by
7373 the institution.
7474 SECTION 3. Section 56.465(a), Education Code, is amended to
7575 read as follows:
7676 (a) The governing board of each institution of higher
7777 education shall cause to be set aside five percent of the amount of
7878 the tuition charged to a resident undergraduate student at the
7979 institution under Section 54.0513 in excess of $46 per semester
8080 credit hour. The amount of a student's tuition set aside under this
8181 subsection is not considered a part of the amount, if any, [required
8282 to be] set aside from that tuition under Section 56.011.
8383 SECTION 4. The changes in law made by this Act apply
8484 beginning with designated tuition set aside by an institution of
8585 higher education for the 2016 fall semester. Designated tuition
8686 set aside for a semester or term before the 2016 fall semester is
8787 governed by the law in effect immediately before the effective date
8888 of this Act, and the former law is continued in effect for that
8989 purpose.
9090 SECTION 5. This Act takes effect January 1, 2016.
