66 AN ACT
77 relating to certain privileges of a parent or guardian in a criminal
88 or civil proceeding involving a child of the parent or guardian.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 38, Code of Criminal Procedure, is
1111 amended by adding Article 38.0742 to read as follows:
1212 Art. 38.0742. PRIVILEGE OF PARENT OR GUARDIAN. (a) In this
1313 article:
1414 (1) "Child" has the meaning assigned by Section
1515 22.011(c), Penal Code.
1616 (2) "Confidential communication" means a
1717 communication that is made privately by a parent or guardian to a
1818 child of the parent or guardian and is not intended to be disclosed
1919 to any other person.
2020 (b) A parent or guardian has a privilege to refuse to
2121 testify against a child of the parent or guardian in a criminal
2222 proceeding. A parent or guardian has a privilege in a criminal
2323 proceeding to refuse to disclose and to prevent another from
2424 disclosing a confidential communication made to a child of the
2525 parent or guardian.
2626 (c) A privilege under this article may be claimed only by a
2727 parent or guardian.
2828 (d) A privilege under this article does not apply in any
2929 proceeding in which the child is charged with an offense against the
3030 child's parent or guardian or a member of the parent's or guardian's
3131 household.
3232 (e) This article does not prohibit a parent or guardian from
3333 testifying voluntarily against a child of the parent or guardian. A
3434 parent or guardian who testifies voluntarily is subject to
3535 cross-examination.
3636 SECTION 2. Subchapter B, Chapter 22, Civil Practice and
3737 Remedies Code, is amended by adding Section 22.013 to read as
3838 follows:
3939 Sec. 22.013. PRIVILEGE OF PARENT OR GUARDIAN. (a) In this
4040 section:
4141 (1) "Child" means a person younger than 17 years of
4242 age.
4343 (2) "Confidential communication" means a
4444 communication that is made privately by a parent or guardian to a
4545 child of the parent or guardian and is not intended to be disclosed
4646 to any other person.
4747 (b) A parent or guardian has a privilege to refuse to
4848 testify against a child of the parent or guardian in a civil
4949 proceeding. A parent or guardian has a privilege in a civil
5050 proceeding to refuse to disclose and to prevent another from
5151 disclosing a confidential communication made to a child of the
5252 parent or guardian.
5353 (c) A privilege under this section may be claimed only by a
5454 parent or guardian.
5555 (d) A privilege under this section does not apply if, at the
5656 time of the civil proceeding, the child of the parent or guardian is
5757 charged with a criminal offense against the parent or guardian or a
5858 member of the parent's or guardian's household.
5959 (e) This section does not prohibit a parent or guardian from
6060 testifying voluntarily against a child of the parent or guardian. A
6161 parent or guardian who testifies voluntarily is subject to
6262 cross-examination.
6363 SECTION 3. The changes in law made by this Act apply only to
6464 a criminal proceeding or civil action that commences on or after the
6565 effective date of this Act. A proceeding or action that commences
6666 before the effective date of this Act is governed by the law in
6767 effect on the date the proceeding or action commences, and the
6868 former law is continued in effect for that purpose.
6969 SECTION 4. This Act takes effect September 1, 2015.
