66 AN ACT
77 relating to the acceptance of a voter at a polling place.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 63.001(g), Election Code, is amended to
1010 read as follows:
1111 (g) If the requirements for identification prescribed by
1212 Subsection (b) are not met or the voter's name is not on the list of
1313 registered voters for the precinct, the voter may be accepted for
1414 provisional voting only under Section 63.011. For a voter who is
1515 not accepted for voting under this section, an election officer
1616 shall:
1717 (1) inform the voter of the voter's right to cast a
1818 provisional ballot under Section 63.011; and
1919 (2) provide the voter with written information, in a
2020 form prescribed by the secretary of state, that:
2121 (A) lists the requirements for identification;
2222 (B) states the procedure for presenting
2323 identification under Section 65.0541;
2424 (C) includes a map showing the location where
2525 identification must be presented; and
2626 (D) includes notice that if all procedures are
2727 followed and the voter is found to be eligible to vote and is voting
2828 in the correct precinct, the voter's provisional ballot will be
2929 accepted.
3030 SECTION 2. Section 15.022(a), Election Code, is amended to
3131 read as follows:
3232 (a) The registrar shall make the appropriate corrections in
3333 the registration records, including, if necessary, deleting a
3434 voter's name from the suspense list:
3535 (1) after receipt of a notice of a change in
3636 registration information under Section 15.021;
3737 (2) after receipt of a voter's reply to a notice of
3838 investigation given under Section 16.033;
3939 (3) [after receipt of any affidavits executed under
4040 Section 63.006, following an election;
4141 [(4)] after receipt of a voter's statement of
4242 residence executed under Section 63.0011;
4343 (4) [(5)] before the effective date of the abolishment
4444 of a county election precinct or a change in its boundary;
4545 (5) [(6)] after receipt of United States Postal
4646 Service information indicating an address reclassification;
4747 (6) [(7)] after receipt of a voter's response under
4848 Section 15.053; or
4949 (7) [(8)] after receipt of a registration application
5050 or change of address under Chapter 20.
5151 SECTION 3. Section 63.011(a), Election Code, is amended to
5252 read as follows:
5353 (a) A person to whom Section 63.001(g) [or 63.009] applies
5454 may cast a provisional ballot if the person executes an affidavit
5555 stating that the person:
5656 (1) is a registered voter in the precinct in which the
5757 person seeks to vote; and
5858 (2) is eligible to vote in the election.
5959 SECTION 4. Section 66.0241, Election Code, is amended to
6060 read as follows:
6161 Sec. 66.0241. CONTENTS OF ENVELOPE NO. 4. Envelope no. 4
6262 must contain:
6363 (1) the precinct list of registered voters;
6464 (2) the registration correction list;
6565 (3) any statements of residence executed under Section
6666 63.0011; and
6767 (4) any affidavits executed under Section [63.006 or]
6868 63.011.
6969 SECTION 5. Sections 63.006 and 63.009, Election Code, are
7070 repealed.
7171 SECTION 6. This Act takes effect September 1, 2015.
