| 7 | 7 | | relating to the authority of certain entities to enter into a |

| 8 | 8 | | comprehensive development agreement. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 223.201(j), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (j) Before the department may enter into a comprehensive |
|---|
| 13 | 13 | | development agreement under Subsection (f), the department must: |
|---|
| 14 | 14 | | (1) for a project other than the State Highway 99 |
|---|
| 15 | 15 | | (Grand Parkway) project, obtain, not later than August 31, 2017, |
|---|
| 16 | 16 | | the appropriate environmental clearance: |
|---|
| 17 | 17 | | (A) for the project; or |
|---|
| 18 | 18 | | (B) for the initial or base scope of the project |
|---|
| 19 | 19 | | if the project agreement provides for the phased construction of |
|---|
| 20 | 20 | | the project; [and] |
|---|
| 21 | 21 | | (2) present to the commission a full financial plan |
|---|
| 22 | 22 | | for the project, including costing methodology and cost proposals; |
|---|
| 23 | 23 | | and |
|---|
| 24 | 24 | | (3) obtain from the county commissioners court of each |
|---|
| 25 | 25 | | county containing a portion of a project that is the subject of the |
|---|
| 26 | 26 | | comprehensive development agreement an order approving the |
|---|
| 27 | 27 | | project. |

| 28 | 28 | | SECTION 2. Section 366.401, Transportation Code, is amended |
|---|
| 29 | 29 | | by adding Subsection (e) to read as follows: |
|---|
| 30 | 30 | | (e) An authority may not enter into a comprehensive |
|---|
| 31 | 31 | | development agreement under this subchapter until the authority |
|---|
| 32 | 32 | | obtains from the county commissioners court of each county |
|---|
| 33 | 33 | | containing a portion of a turnpike project that is the subject of |
|---|
| 34 | 34 | | the comprehensive development agreement an order approving the |
|---|
| 35 | 35 | | project. |
|---|
| 36 | 36 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 37 | 37 | | a comprehensive development agreement entered into on or after the |
|---|
| 38 | 38 | | effective date of this Act. A comprehensive development agreement |
|---|
| 39 | 39 | | entered into before the effective date of this Act is governed by |
|---|
| 40 | 40 | | the law in effect when the agreement was entered into, and the |
|---|
| 41 | 41 | | former law is continued in effect for that purpose. |

| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2015. |
