55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of certain entities to enter into a
88 comprehensive development agreement.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 223.201(j), Transportation Code, is
1111 amended to read as follows:
1212 (j) Before the department may enter into a comprehensive
1313 development agreement under Subsection (f), the department must:
1414 (1) for a project other than the State Highway 99
1515 (Grand Parkway) project, obtain, not later than August 31, 2017,
1616 the appropriate environmental clearance:
1717 (A) for the project; or
1818 (B) for the initial or base scope of the project
1919 if the project agreement provides for the phased construction of
2020 the project; [and]
2121 (2) present to the commission a full financial plan
2222 for the project, including costing methodology and cost proposals;
2323 and
2424 (3) obtain from the county commissioners court of each
2525 county containing a portion of a project that is the subject of the
2626 comprehensive development agreement an order approving the
2727 project.
2828 SECTION 2. Section 366.401, Transportation Code, is amended
2929 by adding Subsection (e) to read as follows:
3030 (e) An authority may not enter into a comprehensive
3131 development agreement under this subchapter until the authority
3232 obtains from the county commissioners court of each county
3333 containing a portion of a turnpike project that is the subject of
3434 the comprehensive development agreement an order approving the
3535 project.
3636 SECTION 3. The changes in law made by this Act apply only to
3737 a comprehensive development agreement entered into on or after the
3838 effective date of this Act. A comprehensive development agreement
3939 entered into before the effective date of this Act is governed by
4040 the law in effect when the agreement was entered into, and the
4141 former law is continued in effect for that purpose.
4242 SECTION 4. This Act takes effect September 1, 2015.
