66 AN ACT
77 relating to permissible uses of graywater for domestic use.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 341.039, Health and Safety Code, is
1010 amended by adding Subsection (a-1) and amending Subsection (c) to
1111 read as follows:
1212 (a-1) The standards adopted by the commission under
1313 Subsection (a)(2) must permit the use of graywater for toilet and
1414 urinal flushing.
1515 (c) The commission may not require a permit for the domestic
1616 use of less than 400 gallons of graywater each day if the graywater:
1717 (1) originates from a private residence;
1818 (2) is used by the occupants of that residence for
1919 gardening, composting, [or] landscaping, or toilet or urinal
2020 flushing at the residence;
2121 (3) is collected using a system that overflows into a
2222 sewage collection or on-site wastewater treatment and disposal
2323 system;
2424 (4) is stored in tanks that:
2525 (A) are clearly labeled as nonpotable water;
2626 (B) restrict access, especially to children; and
2727 (C) eliminate habitat for mosquitoes and other
2828 vectors;
2929 (5) uses piping clearly identified as a nonpotable
3030 water conduit, including identification through the use of purple
3131 pipe, purple tape, or similar markings;
3232 (6) is generated without the formation of ponds or
3333 pools of graywater;
3434 (7) does not create runoff across the property lines
3535 or onto any paved surface; and
3636 (8) is distributed by a surface or subsurface system
3737 that does not spray into the air.
3838 SECTION 2. Section 26.0311, Water Code, is amended by
3939 adding Subsection (b-1) to read as follows:
4040 (b-1) The standards adopted by the commission under
4141 Subsection (b)(2) must permit the use of graywater for toilet and
4242 urinal flushing.
4343 SECTION 3. The Texas Commission on Environmental Quality
4444 shall adopt the standards required by Section 341.039, Health and
4545 Safety Code, as amended by this Act, and Section 26.0311, Water
4646 Code, as amended by this Act, not later than January 1, 2016.
4747 SECTION 4. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2015.
