| 7 | 7 | | relating to permissible uses of graywater for domestic use. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 341.039, Health and Safety Code, is |
|---|
| 10 | 10 | | amended by adding Subsection (a-1) and amending Subsection (c) to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a-1) The standards adopted by the commission under |
|---|
| 13 | 13 | | Subsection (a)(2) must permit the use of graywater for toilet and |
|---|
| 14 | 14 | | urinal flushing. |
|---|
| 15 | 15 | | (c) The commission may not require a permit for the domestic |
|---|
| 16 | 16 | | use of less than 400 gallons of graywater each day if the graywater: |
|---|
| 17 | 17 | | (1) originates from a private residence; |
|---|
| 18 | 18 | | (2) is used by the occupants of that residence for |
|---|
| 19 | 19 | | gardening, composting, [or] landscaping, or toilet or urinal |
|---|
| 20 | 20 | | flushing at the residence; |
|---|
| 21 | 21 | | (3) is collected using a system that overflows into a |
|---|
| 22 | 22 | | sewage collection or on-site wastewater treatment and disposal |
|---|
| 23 | 23 | | system; |
|---|
| 24 | 24 | | (4) is stored in tanks that: |
|---|
| 25 | 25 | | (A) are clearly labeled as nonpotable water; |
|---|
| 26 | 26 | | (B) restrict access, especially to children; and |
|---|
| 27 | 27 | | (C) eliminate habitat for mosquitoes and other |
|---|
| 28 | 28 | | vectors; |
|---|
| 29 | 29 | | (5) uses piping clearly identified as a nonpotable |
|---|
| 30 | 30 | | water conduit, including identification through the use of purple |
|---|
| 31 | 31 | | pipe, purple tape, or similar markings; |
|---|
| 32 | 32 | | (6) is generated without the formation of ponds or |
|---|
| 33 | 33 | | pools of graywater; |
|---|
| 34 | 34 | | (7) does not create runoff across the property lines |
|---|
| 35 | 35 | | or onto any paved surface; and |
|---|
| 36 | 36 | | (8) is distributed by a surface or subsurface system |
|---|
| 37 | 37 | | that does not spray into the air. |
|---|
| 38 | 38 | | SECTION 2. Section 26.0311, Water Code, is amended by |
|---|
| 39 | 39 | | adding Subsection (b-1) to read as follows: |
|---|
| 40 | 40 | | (b-1) The standards adopted by the commission under |
|---|
| 41 | 41 | | Subsection (b)(2) must permit the use of graywater for toilet and |
|---|
| 42 | 42 | | urinal flushing. |
|---|
| 43 | 43 | | SECTION 3. The Texas Commission on Environmental Quality |
|---|
| 44 | 44 | | shall adopt the standards required by Section 341.039, Health and |
|---|
| 45 | 45 | | Safety Code, as amended by this Act, and Section 26.0311, Water |
|---|
| 46 | 46 | | Code, as amended by this Act, not later than January 1, 2016. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2015. |
