| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 84.002, Election Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (c) to read as follows: |
|---|
| 11 | 11 | | (c) A voter may indicate on the voter's application for a |
|---|
| 12 | 12 | | ballot to be voted by mail on the ground of age or disability |
|---|
| 13 | 13 | | submitted to the county clerk that the application is for ballots to |
|---|
| 14 | 14 | | be voted by mail in each election for which the county clerk serves |
|---|
| 15 | 15 | | as the early voting clerk held before the end of the calendar year |
|---|
| 16 | 16 | | in which the first presidential election is held following the date |
|---|
| 17 | 17 | | the application is submitted. |
|---|
| 18 | 18 | | SECTION 2. Section 86.0015, Election Code, is amended by |
|---|
| 19 | 19 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 20 | 20 | | follows: |
|---|
| 21 | 21 | | (b) An application described by Subsection (a) is |
|---|
| 22 | 22 | | considered to be an application for a ballot for each election in |
|---|
| 23 | 23 | | which the county clerk serves as early voting clerk and: |
|---|
| 24 | 24 | | (1) in which the applicant is eligible to vote; and |
|---|
| 25 | 25 | | (2) that occurs before [the earlier of: |
|---|
| 26 | 26 | | [(A)] the end of the calendar year in which: |
|---|
| 27 | 27 | | (A) the application was submitted; or |
|---|
| 28 | 28 | | (B) if requested on the voter's application, the |
|---|
| 29 | 29 | | first presidential election is held following the date the |
|---|
| 30 | 30 | | application was submitted. |
|---|
| 31 | 31 | | (b-1) Notwithstanding Subsection (b), the county clerk may |
|---|
| 32 | 32 | | not provide a ballot to a voter under this section after the date |
|---|
| 33 | 33 | | the county clerk receives notice from the voter registrar under |
|---|
| 34 | 34 | | Subsection (d) that the voter has submitted a change in |
|---|
| 35 | 35 | | registration information. |
|---|
| 36 | 36 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to an application for a ballot to be voted by mail received on or |
|---|
| 38 | 38 | | after the effective date of this Act. |
|---|
| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2015. |
