66 AN ACT
77 relating to an application for a ballot to be voted by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 84.002, Election Code, is amended by
1010 adding Subsection (c) to read as follows:
1111 (c) A voter may indicate on the voter's application for a
1212 ballot to be voted by mail on the ground of age or disability
1313 submitted to the county clerk that the application is for ballots to
1414 be voted by mail in each election for which the county clerk serves
1515 as the early voting clerk held before the end of the calendar year
1616 in which the first presidential election is held following the date
1717 the application is submitted.
1818 SECTION 2. Section 86.0015, Election Code, is amended by
1919 amending Subsection (b) and adding Subsection (b-1) to read as
2020 follows:
2121 (b) An application described by Subsection (a) is
2222 considered to be an application for a ballot for each election in
2323 which the county clerk serves as early voting clerk and:
2424 (1) in which the applicant is eligible to vote; and
2525 (2) that occurs before [the earlier of:
2626 [(A)] the end of the calendar year in which:
2727 (A) the application was submitted; or
2828 (B) if requested on the voter's application, the
2929 first presidential election is held following the date the
3030 application was submitted.
3131 (b-1) Notwithstanding Subsection (b), the county clerk may
3232 not provide a ballot to a voter under this section after the date
3333 the county clerk receives notice from the voter registrar under
3434 Subsection (d) that the voter has submitted a change in
3535 registration information.
3636 SECTION 3. The change in law made by this Act applies only
3737 to an application for a ballot to be voted by mail received on or
3838 after the effective date of this Act.
3939 SECTION 4. This Act takes effect September 1, 2015.
