77 relating to the regulation of package store permit holders.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 22.06, Alcoholic Beverage Code, is
1010 amended to read as follows:
1111 Sec. 22.06. PROHIBITED INTERESTS. (a) Except as otherwise
1212 provided in Section 102.05 of this code and in Subsection (b) of
1313 this section, no person who holds a package store permit or owns an
1414 interest in a package store may have a direct or indirect interest
1515 in any of the following:
1616 (1) a manufacturer's, retail dealer's on-premise, or
1717 general, branch, or local distributor's license;
1818 (2) a wine and beer retailer's[, wine and beer
1919 retailer's off-premise,] or mixed beverage permit; or
2020 (3) the business of any of the permits or licenses
2121 listed in Subdivisions (1) and (2) of this subsection.
2222 (b) A package store permit and a retail dealer's off-premise
2323 license or a wine and beer retailer's off-premise permit may be
2424 issued to the same person.
2525 SECTION 2. Section 22.14(d), Alcoholic Beverage Code, is
2626 amended to read as follows:
2727 (d) Subsections (a) and [,] (b)[, and (c)] shall not apply
2828 to a package store that qualifies for exemption under Section 11.50
2929 or to a package store in a hotel that qualifies for exemption under
3030 Section 102.05.
3131 SECTION 3. Sections 22.04, 22.05, 22.14(c), and 22.16,
3232 Alcoholic Beverage Code, are repealed.
3333 SECTION 4. This Act takes effect September 1, 2015.
