77 AN ACT
88 relating to the membership of school district and open-enrollment
99 charter school concussion oversight teams.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 38.151, Education Code, is amended by
1212 adding Subdivision (2-a) and amending Subdivision (5) to read as
1313 follows:
1414 (2-a) "Chiropractor" has the meaning assigned by
1515 Section 201.001, Occupations Code.
1616 (5) "Licensed health care professional" means an
1717 advanced practice nurse, athletic trainer, chiropractor,
1818 neuropsychologist, or physician assistant, as those terms are
1919 defined by this section.
2020 SECTION 2. Section 38.154(a), Education Code, is amended to
2121 read as follows:
2222 (a) Each concussion oversight team must include at least one
2323 physician and, to the greatest extent practicable, considering
2424 factors including the population of the metropolitan statistical
2525 area in which the school district or open-enrollment charter school
2626 is located, district or charter school student enrollment, and the
2727 availability of and access to licensed health care professionals in
2828 the district or charter school area, must also include one or more
2929 of the following:
3030 (1) an athletic trainer;
3131 (2) an advanced practice nurse;
3232 (3) a neuropsychologist; [or]
3333 (4) a physician assistant; or
3434 (5) a chiropractor.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2015.
