| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 419.909, Government Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) Except as provided by Subsection (a-1), only [Only] an |
|---|
| 14 | 14 | | individual certified by the commission as a fire inspector may |
|---|
| 15 | 15 | | conduct a fire safety inspection required by a state or local law, |
|---|
| 16 | 16 | | rule, regulation, or ordinance. The following entities may provide |
|---|
| 17 | 17 | | training related to fire safety inspections: |
|---|
| 18 | 18 | | (1) the commission or a training facility certified by |
|---|
| 19 | 19 | | the commission; |
|---|
| 20 | 20 | | (2) the State Firefighters' and Fire Marshals' |
|---|
| 21 | 21 | | Association of Texas or a training facility approved by that |
|---|
| 22 | 22 | | association; |
|---|
| 23 | 23 | | (3) the National Fire Protection Association; |
|---|
| 24 | 24 | | (4) the International Code Council; |
|---|
| 25 | 25 | | (5) any state agency with authority over fire safety |
|---|
| 26 | 26 | | inspections; or |
|---|
| 27 | 27 | | (6) any local agency authorized to provide the |
|---|
| 28 | 28 | | training by a state agency described by Subdivision (5). |

| 29 | 29 | | (a-1) For purposes of conducting a fire safety inspection |
|---|
| 30 | 30 | | under Subsection (a), an individual is not required to be certified |
|---|
| 31 | 31 | | by the commission if the inspection is conducted in a county with a |
|---|
| 32 | 32 | | population of less than 250,000 and the individual: |
|---|
| 33 | 33 | | (1) has completed training on fire safety inspections |
|---|
| 34 | 34 | | offered by an entity described by that subsection; or |
|---|
| 35 | 35 | | (2) is a member of a volunteer fire department. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2015. |
