55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to persons authorized by law to conduct certain fire
88 safety inspections and training.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 419.909, Government Code, is amended by
1111 amending Subsection (a) and adding Subsection (a-1) to read as
1212 follows:
1313 (a) Except as provided by Subsection (a-1), only [Only] an
1414 individual certified by the commission as a fire inspector may
1515 conduct a fire safety inspection required by a state or local law,
1616 rule, regulation, or ordinance. The following entities may provide
1717 training related to fire safety inspections:
1818 (1) the commission or a training facility certified by
1919 the commission;
2020 (2) the State Firefighters' and Fire Marshals'
2121 Association of Texas or a training facility approved by that
2222 association;
2323 (3) the National Fire Protection Association;
2424 (4) the International Code Council;
2525 (5) any state agency with authority over fire safety
2626 inspections; or
2727 (6) any local agency authorized to provide the
2828 training by a state agency described by Subdivision (5).
2929 (a-1) For purposes of conducting a fire safety inspection
3030 under Subsection (a), an individual is not required to be certified
3131 by the commission if the inspection is conducted in a county with a
3232 population of less than 250,000 and the individual:
3333 (1) has completed training on fire safety inspections
3434 offered by an entity described by that subsection; or
3535 (2) is a member of a volunteer fire department.
3636 SECTION 2. This Act takes effect September 1, 2015.
