1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8490 to read as follows:
1313 CHAPTER 8490. MORNINGSTAR RANCH MUNICIPAL UTILITY DISTRICT NO. 1
1414 OF PARKER COUNTY
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 8490.001. DEFINITION. In this chapter, "district"
1717 means the Morningstar Ranch Municipal Utility District No. 1 of
1818 Parker County.
1919 Sec. 8490.002. NATURE AND PURPOSES OF DISTRICT. (a) The
2020 district is a municipal utility district created under Section 59,
2121 Article XVI, Texas Constitution.
2222 (b) The district is created to accomplish the purposes of:
2323 (1) a municipal utility district as provided by
2424 general law and Section 59, Article XVI, Texas Constitution; and
2525 (2) Section 52, Article III, Texas Constitution, that
2626 relate to the construction, acquisition, improvement, operation,
2727 or maintenance of macadamized, graveled, or paved roads, or
2828 improvements, including storm drainage, in aid of those roads.
2929 SUBCHAPTER B. POWERS AND DUTIES
3030 Sec. 8490.051. GENERAL POWERS AND DUTIES. The district has
3131 the powers and duties necessary to accomplish the purposes for
3232 which the district is created.
3333 Sec. 8490.052. MUNICIPAL UTILITY DISTRICT POWERS AND
3434 DUTIES. The district has the powers and duties provided by the
3535 general law of this state, including Chapters 49 and 54, Water Code,
3636 applicable to municipal utility districts created under Section 59,
3737 Article XVI, Texas Constitution.
3838 Sec. 8490.053. AUTHORITY FOR ROAD PROJECTS. Under Section
3939 52, Article III, Texas Constitution, the district may design,
4040 acquire, construct, finance, issue bonds for, improve, operate,
4141 maintain, and convey to this state, a county, or a municipality for
4242 operation and maintenance macadamized, graveled, or paved roads, or
4343 improvements, including storm drainage, in aid of those roads.
4444 Sec. 8490.054. ROAD STANDARDS AND REQUIREMENTS. (a) A road
4545 project must meet all applicable construction standards, zoning and
4646 subdivision requirements, and regulations of each municipality in
4747 whose corporate limits or extraterritorial jurisdiction the road
4848 project is located.
4949 (b) If a road project is not located in the corporate limits
5050 or extraterritorial jurisdiction of a municipality, the road
5151 project must meet all applicable construction standards,
5252 subdivision requirements, and regulations of each county in which
5353 the road project is located.
5454 (c) If the state will maintain and operate the road, the
5555 Texas Transportation Commission must approve the plans and
5656 specifications of the road project.
5757 SUBCHAPTER C. BONDS AND OTHER OBLIGATIONS
5858 Sec. 8490.101. AUTHORITY TO ISSUE BONDS AND OTHER
5959 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds or
6060 other obligations payable wholly or partly from ad valorem taxes,
6161 revenue, contract payments, grants, or other district money, or any
6262 combination of those sources, to pay for a road project authorized
6363 by Section 8490.053.
6464 (b) The district may not issue bonds payable from ad valorem
6565 taxes to finance a road project unless the issuance is approved by a
6666 vote of a two-thirds majority of the district voters voting at an
6767 election held for that purpose.
6868 (c) At the time of issuance, the total principal amount of
6969 bonds or other obligations issued or incurred to finance road
7070 projects and payable from ad valorem taxes may not exceed
7171 one-fourth of the assessed value of the real property in the
7272 district.
7373 Sec. 8490.102. TAXES FOR BONDS. At the time the district
7474 issues bonds payable wholly or partly from ad valorem taxes, the
7575 district shall provide for the annual imposition of a continuing
7676 direct ad valorem tax, without limit as to rate or amount, while all
7777 or part of the bonds are outstanding as required and in the manner
7878 provided by Sections 54.601 and 54.602, Water Code.
7979 SECTION 2. Subtitle F, Title 6, Special District Local Laws
8080 Code, is amended by adding Chapter 8491 to read as follows:

8383 SUBCHAPTER A. GENERAL PROVISIONS
8484 Sec. 8491.001. DEFINITION. In this chapter, "district"
8585 means the Morningstar Ranch Municipal Utility District No. 2 of
8686 Parker County.
8787 Sec. 8491.002. NATURE AND PURPOSES OF DISTRICT. (a) The
8888 district is a municipal utility district created under Section 59,
8989 Article XVI, Texas Constitution.
9090 (b) The district is created to accomplish the purposes of:
9191 (1) a municipal utility district as provided by
9292 general law and Section 59, Article XVI, Texas Constitution; and
9393 (2) Section 52, Article III, Texas Constitution, that
9494 relate to the construction, acquisition, improvement, operation,
9595 or maintenance of macadamized, graveled, or paved roads, or
9696 improvements, including storm drainage, in aid of those roads.

147147 SECTION 3. The Morningstar Ranch Municipal Utility
148148 Districts Nos. 1 and 2 of Parker County retain all rights, powers,
149149 privileges, authority, duties, and functions that they had before
150150 the effective date of this Act.
151151 SECTION 4. (a) The legal notice of the intention to
152152 introduce this Act, setting forth the general substance of this
153153 Act, has been published as provided by law, and the notice and a
154154 copy of this Act have been furnished to all persons, agencies,
155155 officials, or entities to which they are required to be furnished
156156 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
157157 Government Code.
158158 (b) The governor, one of the required recipients, has
159159 submitted the notice and Act to the Texas Commission on
160160 Environmental Quality.
161161 (c) The Texas Commission on Environmental Quality has filed
162162 its recommendations relating to this Act with the governor, the
163163 lieutenant governor, and the speaker of the house of
164164 representatives within the required time.
165165 (d) All requirements of the constitution and laws of this
166166 state and the rules and procedures of the legislature with respect
167167 to the notice, introduction, and passage of this Act are fulfilled
168168 and accomplished.
169169 SECTION 5. This Act takes effect immediately if it receives
170170 a vote of two-thirds of all the members elected to each house, as
171171 provided by Section 39, Article III, Texas Constitution. If this
172172 Act does not receive the vote necessary for immediate effect, this
173173 Act takes effect September 1, 2015.
