55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing the issuance of revenue bonds for capital
88 projects at Tarleton State University.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Section 55.1781 to read as follows:
1212 Sec. 55.1781. TARLETON STATE UNIVERSITY; ADDITIONAL BONDS.
1313 (a) In addition to the other authority granted under this
1414 subchapter, the board of regents of The Texas A&M University System
1515 may acquire, purchase, construct, improve, renovate, enlarge, or
1616 equip property and facilities, including roads and related
1717 infrastructure, for Tarleton State University for the following
1818 projects to be financed by the issuance of bonds in accordance with
1919 a systemwide revenue financing program and secured as provided by
2020 that program, in aggregate principal amounts not to exceed:
2121 (1) $75 million for an applied sciences building; and
2222 (2) $55 million for a Southwest Metroplex building in
2323 Tarrant County.
2424 (b) The board may pledge irrevocably to the payment of the
2525 bonds authorized by this section all or any part of the revenue
2626 funds of an institution, branch, or entity of The Texas A&M
2727 University System, including student tuition charges. The amount
2828 of a pledge made under this subsection may not be reduced or
2929 abrogated while the bonds for which the pledge is made, or bonds
3030 issued to refund those bonds, are outstanding.
3131 (c) If sufficient funds are not available to the board to
3232 meet its obligations under this section, the board may transfer
3333 funds among institutions, branches, and entities of The Texas A&M
3434 University System to ensure the most equitable and efficient
3535 allocation of available resources for each institution, branch, or
3636 entity to carry out its duties and purposes.
3737 SECTION 2. This Act does not affect any authority or
3838 restriction regarding the activities that a public institution of
3939 higher education may conduct in connection with a facility financed
4040 by bonds authorized by this Act.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2015.
