66 AN ACT
77 relating to the work requirements of the supplemental nutrition
88 assistance program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1111 is amended by adding Section 33.016 to read as follows:
1212 Sec. 33.016. EFFECT OF CERTAIN NONCOMPLIANCE WITH WORK
1313 REQUIREMENTS ON SNAP ELIGIBILITY. As authorized by 7 U.S.C.
1414 Section 2015(d)(1)(C)(iii)(IV), a person who becomes ineligible
1515 for supplemental nutrition assistance benefits for the third time
1616 for refusing or failing without good cause to comply with the
1717 employment or employment and training program requirements of 7
1818 U.S.C. Section 2015(d)(1)(A) is permanently ineligible to receive
1919 those benefits.
2020 SECTION 2. Section 33.016, Human Resources Code, as added
2121 by this Act, applies only to an initial determination or
2222 recertification of eligibility for the supplemental nutrition
2323 assistance program under Chapter 33, Human Resources Code, that is
2424 made on or after the effective date of this Act. A determination or
2525 recertification made before the effective date of this Act is
2626 governed by the law in effect on the date the determination or
2727 recertification was made, and the former law is continued in effect
2828 for that purpose.
2929 SECTION 3. If before implementing any provision of this Act
3030 a state agency determines that a waiver or authorization from a
3131 federal agency is necessary for implementation of that provision,
3232 the agency affected by the provision shall request the waiver or
3333 authorization and may delay implementing that provision until the
3434 waiver or authorization is granted.
3535 SECTION 4. This Act takes effect September 1, 2015.
