86 AN ACT
97 relating to monetary assistance by the Department of Family and
108 Protective Services provided to foster parents and relative or
119 designated caregivers for day-care services.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Section 264.124, Family Code, as added by
1412 Chapter 423 (S.B. 430), Acts of the 83rd Legislature, Regular
1513 Session, 2013, is amended by adding Subsection (e) to read as
1614 follows:
1715 (e) On receipt of the verification required under
1816 Subsection (b), or as provided by Subsection (d), the department
1917 shall provide monetary assistance to a foster parent for day care
2018 for a foster child, regardless of the type of day care chosen by the
2119 foster parent. The department may not deny monetary assistance to
2220 the foster parent based on the number of hours the foster parent
2321 works each week.
2422 SECTION 2. Section 264.755, Family Code, is amended by
2523 adding Subsection (f) to read as follows:
2624 (f) On receipt of the verification required under
2725 Subsection (d), or as provided by Subsection (e), the department
2826 shall provide monetary assistance to a relative or designated
2927 caregiver for day care for the child, regardless of the type of day
3028 care chosen by the relative or designated caregiver. The department
3129 may not deny monetary assistance to the relative or designated
3230 caregiver based on the number of hours the relative or designated
3331 caregiver works each week.
3432 SECTION 3. This Act takes effect immediately if it receives
3533 a vote of two-thirds of all the members elected to each house, as
3634 provided by Section 39, Article III, Texas Constitution. If this
3735 Act does not receive the vote necessary for immediate effect, this
3836 Act takes effect September 1, 2015.
