55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of the Department of Agriculture to
88 employ and commission peace officers as investigators.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 12, Agriculture Code, is amended by
1111 adding Section 12.0131 to read as follows:
1212 Sec. 12.0131. EMPLOYMENT OF PEACE OFFICERS. The department
1313 may employ and commission peace officers as investigators to assist
1414 the department in performing its duties.
1515 SECTION 2. Article 2.12, Code of Criminal Procedure, is
1616 amended to read as follows:
1717 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1818 officers:
1919 (1) sheriffs, their deputies, and those reserve
2020 deputies who hold a permanent peace officer license issued under
2121 Chapter 1701, Occupations Code;
2222 (2) constables, deputy constables, and those reserve
2323 deputy constables who hold a permanent peace officer license issued
2424 under Chapter 1701, Occupations Code;
2525 (3) marshals or police officers of an incorporated
2626 city, town, or village, and those reserve municipal police officers
2727 who hold a permanent peace officer license issued under Chapter
2828 1701, Occupations Code;
2929 (4) rangers and officers commissioned by the Public
3030 Safety Commission and the Director of the Department of Public
3131 Safety;
3232 (5) investigators of the district attorneys', criminal
3333 district attorneys', and county attorneys' offices;
3434 (6) law enforcement agents of the Texas Alcoholic
3535 Beverage Commission;
3636 (7) each member of an arson investigating unit
3737 commissioned by a city, a county, or the state;
3838 (8) officers commissioned under Section 37.081,
3939 Education Code, or Subchapter E, Chapter 51, Education Code;
4040 (9) officers commissioned by the General Services
4141 Commission;
4242 (10) law enforcement officers commissioned by the
4343 Parks and Wildlife Commission;
4444 (11) airport police officers commissioned by a city
4545 with a population of more than 1.18 million located primarily in a
4646 county with a population of 2 million or more that operates an
4747 airport that serves commercial air carriers;
4848 (12) airport security personnel commissioned as peace
4949 officers by the governing body of any political subdivision of this
5050 state, other than a city described by Subdivision (11), that
5151 operates an airport that serves commercial air carriers;
5252 (13) municipal park and recreational patrolmen and
5353 security officers;
5454 (14) security officers and investigators commissioned
5555 as peace officers by the comptroller;
5656 (15) officers commissioned by a water control and
5757 improvement district under Section 49.216, Water Code;
5858 (16) officers commissioned by a board of trustees
5959 under Chapter 54, Transportation Code;
6060 (17) investigators commissioned by the Texas Medical
6161 Board;
6262 (18) officers commissioned by:
6363 (A) the board of managers of the Dallas County
6464 Hospital District, the Tarrant County Hospital District, the Bexar
6565 County Hospital District, or the El Paso County Hospital District
6666 under Section 281.057, Health and Safety Code;
6767 (B) the board of directors of the Ector County
6868 Hospital District under Section 1024.117, Special District Local
6969 Laws Code; and
7070 (C) the board of directors of the Midland County
7171 Hospital District of Midland County, Texas, under Section 1061.121,
7272 Special District Local Laws Code;
7373 (19) county park rangers commissioned under
7474 Subchapter E, Chapter 351, Local Government Code;
7575 (20) investigators employed by the Texas Racing
7676 Commission;
7777 (21) officers commissioned under Chapter 554,
7878 Occupations Code;
7979 (22) officers commissioned by the governing body of a
8080 metropolitan rapid transit authority under Section 451.108,
8181 Transportation Code, or by a regional transportation authority
8282 under Section 452.110, Transportation Code;
8383 (23) investigators commissioned by the attorney
8484 general under Section 402.009, Government Code;
8585 (24) security officers and investigators commissioned
8686 as peace officers under Chapter 466, Government Code;
8787 (25) an officer employed by the Department of State
8888 Health Services under Section 431.2471, Health and Safety Code;
8989 (26) officers appointed by an appellate court under
9090 Subchapter F, Chapter 53, Government Code;
9191 (27) officers commissioned by the state fire marshal
9292 under Chapter 417, Government Code;
9393 (28) an investigator commissioned by the commissioner
9494 of insurance under Section 701.104, Insurance Code;
9595 (29) apprehension specialists and inspectors general
9696 commissioned by the Texas Juvenile Justice Department as officers
9797 under Sections 242.102 and 243.052, Human Resources Code;
9898 (30) officers appointed by the inspector general of
9999 the Texas Department of Criminal Justice under Section 493.019,
100100 Government Code;
101101 (31) investigators commissioned by the Texas
102102 Commission on Law Enforcement under Section 1701.160, Occupations
103103 Code;
104104 (32) [commission investigators commissioned by the
105105 Texas Private Security Board under Section 1702.061(f),
106106 Occupations Code;
107107 [(33)] the fire marshal and any officers, inspectors,
108108 or investigators commissioned by an emergency services district
109109 under Chapter 775, Health and Safety Code;
110110 (33) [(34)] officers commissioned by the State Board
111111 of Dental Examiners under Section 254.013, Occupations Code,
112112 subject to the limitations imposed by that section;
113113 (34) [(35)] investigators commissioned by the Texas
114114 Juvenile Justice Department as officers under Section 221.011,
115115 Human Resources Code; [and]
116116 (35) [(36)] the fire marshal and any related officers,
117117 inspectors, or investigators commissioned by a county under
118118 Subchapter B, Chapter 352, Local Government Code; and
119119 (36) investigators commissioned by the Department of
120120 Agriculture under Section 12.0131, Agriculture Code.
121121 SECTION 3. This Act takes effect immediately if it receives
122122 a vote of two-thirds of all the members elected to each house, as
123123 provided by Section 39, Article III, Texas Constitution. If this
124124 Act does not receive the vote necessary for immediate effect, this
125125 Act takes effect September 1, 2015.
