6	6	AN ACT
7	7	relating to the authority of the Department of Agriculture to
8	8	employ and commission peace officers as investigators.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 12, Agriculture Code, is amended by
11	11	adding Section 12.0131 to read as follows:
12	12	Sec. 12.0131. EMPLOYMENT OF PEACE OFFICERS. The department
13	13	may employ and commission peace officers as investigators to assist
14	14	the department in performing its duties.
15	15	SECTION 2. Article 2.12, Code of Criminal Procedure, is
16	16	amended to read as follows:
17	17	Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
18	18	officers:
19	19	(1) sheriffs, their deputies, and those reserve
20	20	deputies who hold a permanent peace officer license issued under
21	21	Chapter 1701, Occupations Code;
22	22	(2) constables, deputy constables, and those reserve
23	23	deputy constables who hold a permanent peace officer license issued
24	24	under Chapter 1701, Occupations Code;
25	25	(3) marshals or police officers of an incorporated
26	26	city, town, or village, and those reserve municipal police officers
27	27	who hold a permanent peace officer license issued under Chapter
28	28	1701, Occupations Code;
29	29	(4) rangers and officers commissioned by the Public
30	30	Safety Commission and the Director of the Department of Public
31	31	Safety;
32	32	(5) investigators of the district attorneys', criminal
33	33	district attorneys', and county attorneys' offices;
34	34	(6) law enforcement agents of the Texas Alcoholic
35	35	Beverage Commission;
36	36	(7) each member of an arson investigating unit
37	37	commissioned by a city, a county, or the state;
38	38	(8) officers commissioned under Section 37.081,
39	39	Education Code, or Subchapter E, Chapter 51, Education Code;
40	40	(9) officers commissioned by the General Services
41	41	Commission;
42	42	(10) law enforcement officers commissioned by the
43	43	Parks and Wildlife Commission;
44	44	(11) airport police officers commissioned by a city
45	45	with a population of more than 1.18 million located primarily in a
46	46	county with a population of 2 million or more that operates an
47	47	airport that serves commercial air carriers;
48	48	(12) airport security personnel commissioned as peace
49	49	officers by the governing body of any political subdivision of this
50	50	state, other than a city described by Subdivision (11), that
51	51	operates an airport that serves commercial air carriers;
52	52	(13) municipal park and recreational patrolmen and
53	53	security officers;
54	54	(14) security officers and investigators commissioned
55	55	as peace officers by the comptroller;
56	56	(15) officers commissioned by a water control and
57	57	improvement district under Section 49.216, Water Code;
58	58	(16) officers commissioned by a board of trustees
59	59	under Chapter 54, Transportation Code;
60	60	(17) investigators commissioned by the Texas Medical
61	61	Board;
62	62	(18) officers commissioned by:
63	63	(A) the board of managers of the Dallas County
64	64	Hospital District, the Tarrant County Hospital District, the Bexar
65	65	County Hospital District, or the El Paso County Hospital District
66	66	under Section 281.057, Health and Safety Code;
67	67	(B) the board of directors of the Ector County
68	68	Hospital District under Section 1024.117, Special District Local
69	69	Laws Code; and
70	70	(C) the board of directors of the Midland County
71	71	Hospital District of Midland County, Texas, under Section 1061.121,
72	72	Special District Local Laws Code;
73	73	(19) county park rangers commissioned under
74	74	Subchapter E, Chapter 351, Local Government Code;
75	75	(20) investigators employed by the Texas Racing
76	76	Commission;
77	77	(21) officers commissioned under Chapter 554,
78	78	Occupations Code;
79	79	(22) officers commissioned by the governing body of a
80	80	metropolitan rapid transit authority under Section 451.108,
81	81	Transportation Code, or by a regional transportation authority
82	82	under Section 452.110, Transportation Code;
83	83	(23) investigators commissioned by the attorney
84	84	general under Section 402.009, Government Code;
85	85	(24) security officers and investigators commissioned
86	86	as peace officers under Chapter 466, Government Code;
87	87	(25) an officer employed by the Department of State
88	88	Health Services under Section 431.2471, Health and Safety Code;
89	89	(26) officers appointed by an appellate court under
90	90	Subchapter F, Chapter 53, Government Code;
91	91	(27) officers commissioned by the state fire marshal
92	92	under Chapter 417, Government Code;
93	93	(28) an investigator commissioned by the commissioner
94	94	of insurance under Section 701.104, Insurance Code;
95	95	(29) apprehension specialists and inspectors general
96	96	commissioned by the Texas Juvenile Justice Department as officers
97	97	under Sections 242.102 and 243.052, Human Resources Code;
98	98	(30) officers appointed by the inspector general of
99	99	the Texas Department of Criminal Justice under Section 493.019,
100	100	Government Code;
101	101	(31) investigators commissioned by the Texas
102	102	Commission on Law Enforcement under Section 1701.160, Occupations
103	103	Code;
104	104	(32) [commission investigators commissioned by the
105	105	Texas Private Security Board under Section 1702.061(f),
106	106	Occupations Code;
107	107	[(33)] the fire marshal and any officers, inspectors,
108	108	or investigators commissioned by an emergency services district
109	109	under Chapter 775, Health and Safety Code;
110	110	(33) [(34)] officers commissioned by the State Board
111	111	of Dental Examiners under Section 254.013, Occupations Code,
112	112	subject to the limitations imposed by that section;
113	113	(34) [(35)] investigators commissioned by the Texas
114	114	Juvenile Justice Department as officers under Section 221.011,
115	115	Human Resources Code; [and]
116	116	(35) [(36)] the fire marshal and any related officers,
117	117	inspectors, or investigators commissioned by a county under
118	118	Subchapter B, Chapter 352, Local Government Code; and
119	119	(36) investigators commissioned by the Department of
120	120	Agriculture under Section 12.0131, Agriculture Code.
121	121	SECTION 3. This Act takes effect immediately if it receives
122	122	a vote of two-thirds of all the members elected to each house, as
123	123	provided by Section 39, Article III, Texas Constitution. If this
124	124	Act does not receive the vote necessary for immediate effect, this
125	125	Act takes effect September 1, 2015.
