104 AN ACT
115 relating to the confidentiality of personal information concerning
126 certain employees currently or formerly involved in the Texas
137 juvenile justice system.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 552.117(a), Government Code, is amended
1610 to read as follows:
1711 (a) Information is excepted from the requirements of
1812 Section 552.021 if it is information that relates to the home
1913 address, home telephone number, emergency contact information, or
2014 social security number of the following person or that reveals
2115 whether the person has family members:
2216 (1) a current or former official or employee of a
2317 governmental body, except as otherwise provided by Section 552.024;
2418 (2) a peace officer as defined by Article 2.12, Code of
2519 Criminal Procedure, or a security officer commissioned under
2620 Section 51.212, Education Code, regardless of whether the officer
2721 complies with Section 552.024 or 552.1175, as applicable;
2822 (3) a current or former employee of the Texas
2923 Department of Criminal Justice or of the predecessor in function of
3024 the department or any division of the department, regardless of
3125 whether the current or former employee complies with Section
3226 552.1175;
3327 (4) a peace officer as defined by Article 2.12, Code of
3428 Criminal Procedure, or other law, a reserve law enforcement
3529 officer, a commissioned deputy game warden, or a corrections
3630 officer in a municipal, county, or state penal institution in this
3731 state who was killed in the line of duty, regardless of whether the
3832 deceased complied with Section 552.024 or 552.1175;
3933 (5) a commissioned security officer as defined by
4034 Section 1702.002, Occupations Code, regardless of whether the
4135 officer complies with Section 552.024 or 552.1175, as applicable;
4236 (6) an officer or employee of a community supervision
4337 and corrections department established under Chapter 76 who
4438 performs a duty described by Section 76.004(b), regardless of
4539 whether the officer or employee complies with Section 552.024 or
4640 552.1175;
4741 (7) a current or former employee of the office of the
4842 attorney general who is or was assigned to a division of that office
4943 the duties of which involve law enforcement, regardless of whether
5044 the current or former employee complies with Section 552.024 or
5145 552.1175;
5246 (8) a current or former employee of the Texas Juvenile
5347 Justice Department or of the predecessors in function of the
5448 department, regardless of whether the current or former employee
5549 complies with Section 552.024 or 552.1175;
5650 (9) a current or former juvenile probation or
5751 supervision officer certified by the Texas Juvenile Justice
5852 Department, or the predecessors in function of the department,
5953 under Title 12, Human Resources Code, regardless of whether the
6054 current or former officer complies with Section 552.024 or
6155 552.1175; or
6256 (10) a current or former employee [employees] of a
6357 juvenile justice program or facility, as those terms are defined by
6458 Section 261.405, Family Code, regardless of whether the current or
6559 former employee complies with Section 552.024 or 552.1175.
6660 SECTION 2. Section 552.1175(a), Government Code, as amended
6761 by Chapters 937 (H.B. 1632) and 1033 (H.B. 2733), Acts of the 83rd
6862 Legislature, Regular Session, 2013, is reenacted and amended to
6963 read as follows:
7064 (a) This section applies only to:
7165 (1) peace officers as defined by Article 2.12, Code of
7266 Criminal Procedure;
7367 (2) county jailers as defined by Section 1701.001,
7468 Occupations Code;
7569 (3) current or former employees of the Texas
7670 Department of Criminal Justice or of the predecessor in function of
7771 the department or any division of the department;
7872 (4) commissioned security officers as defined by
7973 Section 1702.002, Occupations Code;
8074 (5) employees of a district attorney, criminal
8175 district attorney, or county or municipal attorney whose
8276 jurisdiction includes any criminal law or child protective services
8377 matters;
8478 (6) officers and employees of a community supervision
8579 and corrections department established under Chapter 76 who perform
8680 a duty described by Section 76.004(b);
8781 (7) criminal investigators of the United States as
8882 described by Article 2.122(a), Code of Criminal Procedure;
8983 (8) police officers and inspectors of the United
9084 States Federal Protective Service;
9185 (9) current and former employees of the office of the
9286 attorney general who are or were assigned to a division of that
9387 office the duties of which involve law enforcement; [and]
9488 (10) current or former juvenile probation and
9589 detention officers certified by the Texas Juvenile Justice
9690 Department, or the predecessors in function of the department,
9791 under Title 12, Human Resources Code;
9892 (11) current or former employees of a juvenile justice
9993 program or facility, as those terms are defined by Section 261.405,
10094 Family Code; [and]
10195 (12) current or former employees of the Texas Juvenile
10296 Justice Department or the predecessors in function of the
10397 department; and
10498 (13) [(10)] federal judges and state judges as defined
10599 by Section 13.0021, Election Code.
106100 SECTION 3. Section 25.025(a), Tax Code, as reenacted and
107101 amended by Chapters 996 (H.B. 2267) and 1028 (H.B. 2676), Acts of
108102 the 83rd Legislature, Regular Session, 2013, is reenacted and
109103 amended to read as follows:
110104 (a) This section applies only to:
111105 (1) a current or former peace officer as defined by
112106 Article 2.12, Code of Criminal Procedure;
113107 (2) a county jailer as defined by Section 1701.001,
114108 Occupations Code;
115109 (3) an employee of the Texas Department of Criminal
116110 Justice;
117111 (4) a commissioned security officer as defined by
118112 Section 1702.002, Occupations Code;
119113 (5) a victim of family violence as defined by Section
120114 71.004, Family Code, if as a result of the act of family violence
121115 against the victim, the actor is convicted of a felony or a Class A
122116 misdemeanor;
123117 (6) a federal judge, a state judge, or the spouse of a
124118 federal judge or state judge;
125119 (7) a current or former employee of a district
126120 attorney, criminal district attorney, or county or municipal
127121 attorney whose jurisdiction includes any criminal law or child
128122 protective services matters;
129123 (8) an officer or employee of a community supervision
130124 and corrections department established under Chapter 76,
131125 Government Code, who performs a duty described by Section 76.004(b)
132126 of that code;
133127 (9) a criminal investigator of the United States as
134128 described by Article 2.122(a), Code of Criminal Procedure;
135129 (10) a police officer or inspector of the United
136130 States Federal Protective Service;
137131 (11) a current or former United States attorney or
138132 assistant United States attorney and the spouse and child of the
139133 attorney;
140134 (12) a current or former employee of the office of the
141135 attorney general who is or was assigned to a division of that office
142136 the duties of which involve law enforcement; [and]
143137 (13) a medical examiner or person who performs
144138 forensic analysis or testing who is employed by this state or one or
145139 more political subdivisions of this state;
146140 (14) [(13)] a current or former member of the United
147141 States armed forces who has served in an area that the president of
148142 the United States by executive order designates for purposes of 26
149143 U.S.C. Section 112 as an area in which armed forces of the United
150144 States are or have engaged in combat;
151145 (15) a current or former employee of the Texas
152146 Juvenile Justice Department or of the predecessors in function of
153147 the department;
154148 (16) a current or former juvenile probation or
155149 supervision officer certified by the Texas Juvenile Justice
156150 Department, or the predecessors in function of the department,
157151 under Title 12, Human Resources Code; and
158152 (17) a current or former employee of a juvenile
159153 justice program or facility, as those terms are defined by Section
160154 261.405, Family Code.
161155 SECTION 4. To the extent of any conflict, this Act prevails
162156 over another Act of the 84th Legislature, Regular Session, 2015,
163157 relating to nonsubstantive additions to and corrections in enacted
164158 codes.
165159 SECTION 5. This Act takes effect immediately if it receives
166160 a vote of two-thirds of all the members elected to each house, as
167161 provided by Section 39, Article III, Texas Constitution. If this
168162 Act does not receive the vote necessary for immediate effect, this
169163 Act takes effect September 1, 2015.
