55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting local governments from interfering with a
88 person's right to engage in the production of agriculture.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 229, Local Government Code, is amended
1111 by adding Subchapter C to read as follows:
1212 SUBCHAPTER C. REGULATION OF PRODUCTION OF AGRICULTURE
1313 Sec. 229.061. PROHIBITED REGULATIONS. Notwithstanding any
1414 other law, a municipality may not adopt regulations that interfere
1515 with a person's right to engage in the production of agriculture, as
1616 defined by Section 2.001, Agriculture Code.
1717 Sec. 229.062. INJUNCTION. The attorney general may bring
1818 an action in a district court in the name of the state to obtain a
1919 temporary or permanent injunction against a municipality adopting a
2020 regulation in violation of this section.
2121 SECTION 2. Chapter 240, Local Government Code, is amended
2222 by adding Subchapter D to read as follows:
2323 SUBCHAPTER D. REGULATION OF PRODUCTION OF AGRICULTURE
2424 Sec. 240.061. PROHIBITED REGULATIONS. Notwithstanding any
2525 other law, the commissioners court of a county may not adopt
2626 regulations that interfere with a person's right to engage in the
2727 production of agriculture, as defined by Section 2.001, Agriculture
2828 Code.
2929 Sec. 240.062. INJUNCTION. The attorney general may bring
3030 an action in a district court in the name of the state to obtain a
3131 temporary or permanent injunction against a county adopting a
3232 regulation in violation of this section.
3333 SECTION 3. This Act takes effect September 1, 2015.
