9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 20.05(a) and (b), Business & Commerce |
---|
11 | 11 | | Code, are amended to read as follows: |
---|
12 | 12 | | (a) Except as provided by Subsection (b), a consumer |
---|
13 | 13 | | reporting agency may not furnish a consumer report containing |
---|
14 | 14 | | information related to: |
---|
15 | 15 | | (1) a case under Title 11 of the United States Code or |
---|
16 | 16 | | under the federal Bankruptcy Act in which the date of entry of the |
---|
17 | 17 | | order for relief or the date of adjudication predates the consumer |
---|
18 | 18 | | report by more than 10 years; |
---|
19 | 19 | | (2) a suit or judgment in which the date of entry |
---|
20 | 20 | | predates the consumer report by more than seven years or the |
---|
21 | 21 | | governing statute of limitations, whichever is longer; |
---|
22 | 22 | | (3) a tax lien in which the date of payment predates |
---|
23 | 23 | | the consumer report by more than seven years; |
---|
24 | 24 | | (4) a record of arrest, indictment, information, |
---|
25 | 25 | | misdemeanor complaint, or conviction of a crime in which the date of |
---|
26 | 26 | | disposition, release, or parole predates the consumer report by |
---|
27 | 27 | | more than seven years; or |
---|
28 | 28 | | (5) another item or event that predates the consumer |
---|
29 | 29 | | report by more than seven years. |
---|
30 | 30 | | (b) A consumer reporting agency may furnish a consumer |
---|
31 | 31 | | report that contains information described by Subsection (a) if the |
---|
32 | 32 | | information is provided in connection with: |
---|
33 | 33 | | (1) a credit transaction with a principal amount that |
---|
34 | 34 | | is or may reasonably be expected to be $150,000 or more; or |
---|
35 | 35 | | (2) the underwriting of life insurance for a face |
---|
36 | 36 | | amount that is or may reasonably be expected to be $150,000 or |
---|
37 | 37 | | more[; or |
---|
38 | 38 | | [(3) the employment of a consumer at an annual salary |
---|
39 | 39 | | that is or may reasonably be expected to be $75,000 or more]. |
---|
40 | 40 | | SECTION 2. This Act takes effect September 1, 2015. |
