77 relating to certain information reported by consumer reporting
88 agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 20.05(a) and (b), Business & Commerce
1111 Code, are amended to read as follows:
1212 (a) Except as provided by Subsection (b), a consumer
1313 reporting agency may not furnish a consumer report containing
1414 information related to:
1515 (1) a case under Title 11 of the United States Code or
1616 under the federal Bankruptcy Act in which the date of entry of the
1717 order for relief or the date of adjudication predates the consumer
1818 report by more than 10 years;
1919 (2) a suit or judgment in which the date of entry
2020 predates the consumer report by more than seven years or the
2121 governing statute of limitations, whichever is longer;
2222 (3) a tax lien in which the date of payment predates
2323 the consumer report by more than seven years;
2424 (4) a record of arrest, indictment, information,
2525 misdemeanor complaint, or conviction of a crime in which the date of
2626 disposition, release, or parole predates the consumer report by
2727 more than seven years; or
2828 (5) another item or event that predates the consumer
2929 report by more than seven years.
3030 (b) A consumer reporting agency may furnish a consumer
3131 report that contains information described by Subsection (a) if the
3232 information is provided in connection with:
3333 (1) a credit transaction with a principal amount that
3434 is or may reasonably be expected to be $150,000 or more; or
3535 (2) the underwriting of life insurance for a face
3636 amount that is or may reasonably be expected to be $150,000 or
3737 more[; or
3838 [(3) the employment of a consumer at an annual salary
3939 that is or may reasonably be expected to be $75,000 or more].
4040 SECTION 2. This Act takes effect September 1, 2015.
