9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 62.154(d), Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (d) The waiting period required by Subsection (a) must: | |
13 | 13 | (1) extend for a period of 30 [90] days after the last | |
14 | 14 | date on which the applicant was covered under a health benefits | |
15 | 15 | plan; and | |
16 | 16 | (2) apply to a child who was covered by a health | |
17 | 17 | benefits plan at any time during the 30 [90] days before the date of | |
18 | 18 | application for coverage under the child health plan. | |
19 | 19 | SECTION 2. If before implementing any provision of this Act | |
20 | 20 | a state agency determines that a waiver or authorization from a | |
21 | 21 | federal agency is necessary for implementation of that provision, | |
22 | 22 | the agency affected by the provision shall request the waiver or | |
23 | 23 | authorization and may delay implementing that provision until the | |
24 | 24 | authorization is granted. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2015. |
