66 AN ACT
77 relating to the creation of a select interim committee to undertake
88 a comprehensive review of personal financial disclosures made to
99 the Texas Ethics Commission and certain other authorities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. INTERIM STUDY REGARDING PERSONAL FINANCIAL
1212 DISCLOSURES. (a) A select interim committee is created to study
1313 and review the procedures and effects of the filing of personal
1414 financial statements with the Texas Ethics Commission or other
1515 authorities under Chapter 572, Government Code, or other similar
1616 laws.
1717 (b) The study must consider:
1818 (1) the purposes of the current disclosure statutes
1919 and whether the statutes accomplish those purposes;
2020 (2) the effectiveness of the current disclosure
2121 scheme; and
2222 (3) what changes, if any, should be made to more
2323 effectively accomplish the purposes of personal financial
2424 disclosures.
2525 (c) The committee is composed of:
2626 (1) five members appointed by the lieutenant governor
2727 as follows:
2828 (A) two senators;
2929 (B) one representative of an open government
3030 advocacy organization;
3131 (C) one representative of an organization
3232 representing professional media; and
3333 (D) one member of the public;
3434 (2) five members appointed by the speaker of the house
3535 of representatives as follows:
3636 (A) two state representatives;
3737 (B) one representative of an open government
3838 advocacy organization;
3939 (C) one representative of an organization
4040 representing professional media; and
4141 (D) one member of the public; and
4242 (3) one member of the Texas Ethics Commission,
4343 appointed by the presiding officer of the Texas Ethics Commission,
4444 who shall serve as the presiding officer of the committee.
4545 (d) The committee shall convene at the call of the presiding
4646 officer.
4747 (e) The committee has all other powers and duties provided
4848 to a special or select committee by the rules of the senate and
4949 house of representatives, by Subchapter B, Chapter 301, Government
5050 Code, and by policies of the senate and house committees on
5151 administration.
5252 (f) Not later than January 15, 2017, the committee shall
5353 report the committee's findings and recommendations to the
5454 lieutenant governor, the speaker of the house of representatives,
5555 and the governor. The committee shall include in its
5656 recommendations specific statutory and rule changes that appear
5757 necessary from the results of the committee's study under
5858 Subsection (a) of this section.
5959 (g) Not later than the 60th day after the effective date of
6060 this Act, the lieutenant governor, the speaker of the house of
6161 representatives, and the presiding officer of the Texas Ethics
6262 Commission shall appoint the members of the committee created under
6363 this section.
6464 (h) The Texas Legislative Council and the Texas Ethics
6565 Commission shall provide any necessary staff and resources to the
6666 committee created under this section.
6767 SECTION 2. ABOLITION OF COMMITTEE. The committee is
6868 abolished and this Act expires January 20, 2017.
6969 SECTION 3. EFFECTIVE DATE. This Act takes effect
7070 immediately if it receives a vote of two-thirds of all the members
7171 elected to each house, as provided by Section 39, Article III, Texas
7272 Constitution. If this Act does not receive the vote necessary for
7373 immediate effect, this Act takes effect September 1, 2015.
