55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the consequences for an elected officer who threatens,
88 punishes, or intimidates a person based on the person's religious
99 beliefs; creating a criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 21.022(4), Local Government Code, is
1212 amended to read as follows:
1313 (4) "Official misconduct" means intentional unlawful
1414 behavior relating to official duties by an officer entrusted with
1515 the administration of justice or the execution of the law. The term
1616 includes an intentional or corrupt failure, refusal, or neglect of
1717 an officer to perform a duty imposed on the officer by law or the use
1818 of an officer's office to threaten, punish, or intimidate an
1919 individual based on the individual's religious beliefs.
2020 SECTION 2. Subchapter C, Chapter 26, Local Government Code,
2121 is amended by adding Section 26.048 to read as follows:
2222 Sec. 26.048. REMOVAL FROM OFFICE FOR RELIGIOUS TARGETING.
2323 An elected officer of a municipality may be removed from office
2424 under the municipality's removal procedures for the use of the
2525 officer's office to threaten, punish, or intimidate an individual
2626 based on the individual's religious beliefs.
2727 SECTION 3. Section 87.011(3), Local Government Code, is
2828 amended to read as follows:
2929 (3) "Official misconduct" means intentional, unlawful
3030 behavior relating to official duties by an officer entrusted with
3131 the administration of justice or the execution of the law. The term
3232 includes an intentional or corrupt failure, refusal, or neglect of
3333 an officer to perform a duty imposed on the officer by law or the use
3434 of an officer's office to threaten, punish, or intimidate an
3535 individual based on the individual's religious beliefs.
3636 SECTION 4. Section 39.03(a), Penal Code, is amended to read
3737 as follows:
3838 (a) A public servant acting under color of his office or
3939 employment commits an offense if he:
4040 (1) intentionally subjects another to mistreatment or
4141 to arrest, detention, search, seizure, dispossession, assessment,
4242 or lien that he knows is unlawful;
4343 (2) intentionally denies or impedes another in the
4444 exercise or enjoyment of any right, privilege, power, or immunity,
4545 knowing his conduct is unlawful; [or]
4646 (3) intentionally subjects another to sexual
4747 harassment; or
4848 (4) is an elected officer and intentionally threatens,
4949 punishes, or intimidates another based on the other's religious
5050 beliefs.
5151 SECTION 5. This Act takes effect September 1, 2015.
