| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Title 6, Business & Commerce Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | TITLE 6. SALE, RENTAL, OR TRANSFER OF GOODS |
|---|
| 13 | 13 | | SECTION 2. Title 6, Business & Commerce Code, is amended by |
|---|
| 14 | 14 | | adding Chapter 205 to read as follows: |
|---|
| 15 | 15 | | CHAPTER 205. SALE OR RENTAL OF CERTAIN MOTOR VEHICLE TIRES |
|---|
| 16 | 16 | | Sec. 205.001. SALE OR RENTAL OF UNSAFE TIRES PROHIBITED. |
|---|
| 17 | 17 | | (a) A person commits an offense if the person offers for sale or |
|---|
| 18 | 18 | | rental, sells, or rents to another person a motor vehicle tire that |
|---|
| 19 | 19 | | is or will be subject to inspection under Section 548.051, |
|---|
| 20 | 20 | | Transportation Code, and that: |
|---|
| 21 | 21 | | (1) has tire tread less than one-sixteenth of an inch |
|---|
| 22 | 22 | | deep; |
|---|
| 23 | 23 | | (2) has a localized worn spot that exposes the ply or |
|---|
| 24 | 24 | | cord through the tread; |
|---|
| 25 | 25 | | (3) has a tread or sidewall crack, cut, or snag as |
|---|
| 26 | 26 | | measured on the outside of the tire that is more than one inch long |
|---|
| 27 | 27 | | and deep enough to expose the body cords; |
|---|
| 28 | 28 | | (4) has any visible bump, bulge, or knot apparently |
|---|
| 29 | 29 | | related to tread or sidewall separation or partial failure of the |
|---|
| 30 | 30 | | tire structure, including bead area; |
|---|
| 31 | 31 | | (5) has been regrooved or recut below the original |
|---|
| 32 | 32 | | groove depth, except for a special regroovable tire that has extra |
|---|
| 33 | 33 | | undertread rubber for that purpose and is identified as a |
|---|
| 34 | 34 | | regroovable tire; |
|---|
| 35 | 35 | | (6) has been repaired temporarily by the use of a |
|---|
| 36 | 36 | | blowout patch or boot; |
|---|
| 37 | 37 | | (7) has worn tread wear indicators that contact the |
|---|
| 38 | 38 | | road in any two adjacent major grooves in the center or middle of |
|---|
| 39 | 39 | | the tire; or |
|---|
| 40 | 40 | | (8) does not otherwise meet applicable Department of |
|---|
| 41 | 41 | | Public Safety safety standards for the tire under Section 547.101, |
|---|
| 42 | 42 | | Transportation Code. |
|---|
| 43 | 43 | | (b) An offense under this section is a misdemeanor |
|---|
| 44 | 44 | | punishable by a fine of not less than $500 or more than $2,000. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2015. |
