77 relating to the sale or rental of certain motor vehicle tires;
88 creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Title 6, Business & Commerce Code,
1111 is amended to read as follows:
1212 TITLE 6. SALE, RENTAL, OR TRANSFER OF GOODS
1313 SECTION 2. Title 6, Business & Commerce Code, is amended by
1414 adding Chapter 205 to read as follows:
1515 CHAPTER 205. SALE OR RENTAL OF CERTAIN MOTOR VEHICLE TIRES
1616 Sec. 205.001. SALE OR RENTAL OF UNSAFE TIRES PROHIBITED.
1717 (a) A person commits an offense if the person offers for sale or
1818 rental, sells, or rents to another person a motor vehicle tire that
1919 is or will be subject to inspection under Section 548.051,
2020 Transportation Code, and that:
2121 (1) has tire tread less than one-sixteenth of an inch
2222 deep;
2323 (2) has a localized worn spot that exposes the ply or
2424 cord through the tread;
2525 (3) has a tread or sidewall crack, cut, or snag as
2626 measured on the outside of the tire that is more than one inch long
2727 and deep enough to expose the body cords;
2828 (4) has any visible bump, bulge, or knot apparently
2929 related to tread or sidewall separation or partial failure of the
3030 tire structure, including bead area;
3131 (5) has been regrooved or recut below the original
3232 groove depth, except for a special regroovable tire that has extra
3333 undertread rubber for that purpose and is identified as a
3434 regroovable tire;
3535 (6) has been repaired temporarily by the use of a
3636 blowout patch or boot;
3737 (7) has worn tread wear indicators that contact the
3838 road in any two adjacent major grooves in the center or middle of
3939 the tire; or
4040 (8) does not otherwise meet applicable Department of
4141 Public Safety safety standards for the tire under Section 547.101,
4242 Transportation Code.
4343 (b) An offense under this section is a misdemeanor
4444 punishable by a fine of not less than $500 or more than $2,000.
4545 SECTION 3. This Act takes effect September 1, 2015.
