13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Section 502.453, Transportation Code, is amended |
---|
15 | 9 | | to read as follows: |
---|
16 | 10 | | Sec. 502.453. GOVERNMENT-OWNED VEHICLES; PUBLIC SCHOOL |
---|
17 | 11 | | BUSES; FIRE-FIGHTING VEHICLES; COUNTY MARINE LAW ENFORCEMENT |
---|
18 | 12 | | VEHICLES; U.S. COAST GUARD AUXILIARY VEHICLES. (a) The owner of a |
---|
19 | 13 | | motor vehicle, trailer, or semitrailer may annually apply for |
---|
20 | 14 | | registration under Section 502.451 and is exempt from the payment |
---|
21 | 15 | | of a registration fee under this chapter if the vehicle is: |
---|
22 | 16 | | (1) owned by and used exclusively in the service of: |
---|
23 | 17 | | (A) the United States; |
---|
24 | 18 | | (B) this state; or |
---|
25 | 19 | | (C) a county, municipality, or school district in |
---|
26 | 20 | | this state; |
---|
27 | 21 | | (2) owned by a commercial transportation company and |
---|
28 | 22 | | used exclusively to provide public school transportation services |
---|
29 | 23 | | to a school district under Section 34.008, Education Code; |
---|
30 | 24 | | (3) designed and used exclusively for fire fighting; |
---|
31 | 25 | | (4) owned by a volunteer fire department and used |
---|
32 | 26 | | exclusively in the conduct of department business; |
---|
33 | 27 | | (5) privately owned and used by a volunteer |
---|
34 | 28 | | exclusively in county marine law enforcement activities, including |
---|
35 | 29 | | rescue operations, under the direction of the sheriff's department; |
---|
36 | 30 | | [or] |
---|
37 | 31 | | (6) used by law enforcement under an alias for covert |
---|
38 | 32 | | criminal investigations; or |
---|
39 | 33 | | (7) owned by units of the United States Coast Guard |
---|
40 | 34 | | Auxiliary headquartered in Texas and used exclusively for conduct |
---|
41 | 35 | | of United States Coast Guard or Coast Guard Auxiliary business and |
---|
42 | 36 | | operations, including search and rescue, emergency communications, |
---|
43 | 37 | | and disaster operations. |
---|
44 | 38 | | (b) An application for registration under this section must |
---|
45 | 39 | | be made by a person having the authority to certify that the vehicle |
---|
46 | 40 | | meets the exemption requirements prescribed by Subsection (a). An |
---|
47 | 41 | | application for registration under this section of a fire-fighting |
---|
48 | 42 | | vehicle described by Subsection (a)(3) must include a reasonable |
---|
49 | 43 | | description of the vehicle and of any fire-fighting equipment |
---|
50 | 44 | | mounted on the vehicle. An application for registration under this |
---|
51 | 45 | | section of a vehicle described by Subsection (a)(5) must include a |
---|
52 | 46 | | statement signed by a person having the authority to act for a |
---|
53 | 47 | | sheriff's department that the vehicle is used exclusively in marine |
---|
54 | 48 | | law enforcement activities under the direction of the sheriff's |
---|
55 | 49 | | department. An application for registration under this section of |
---|
56 | 50 | | a vehicle described by Subsection (a)(7) must include a statement |
---|
57 | 51 | | signed by a person having authority to act for the United States |
---|
58 | 52 | | Coast Guard Auxiliary that the vehicle or trailer is used |
---|
59 | 53 | | exclusively in fulfillment of an authorized mission of the United |
---|
60 | 54 | | States Coast Guard or Coast Guard Auxiliary, including search and |
---|
61 | 55 | | rescue, patrol, emergency communications, or disaster operations. |
---|
62 | 56 | | SECTION 2. This Act takes effect immediately if it receives |
---|
63 | 57 | | a vote of two-thirds of all the members elected to each house, as |
---|
64 | 58 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
65 | 59 | | Act does not receive the vote necessary for immediate effect, this |
---|
66 | 60 | | Act takes effect September 1, 2015. |
