44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the assignment of a public school student to an
77 inexperienced or uncertified teacher.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 7.056(e), Education Code, is amended to
1010 read as follows:
1111 (e) Except as provided by Subsection (f), a school campus or
1212 district may not receive an exemption or waiver under this section
1313 from:
1414 (1) a prohibition on conduct that constitutes a
1515 criminal offense;
1616 (2) a requirement imposed by federal law or rule,
1717 including a requirement for special education or bilingual
1818 education programs; or
1919 (3) a requirement, restriction, or prohibition
2020 relating to:
2121 (A) essential knowledge or skills under Section
2222 28.002 or high school graduation requirements under Section 28.025;
2323 (B) public school accountability as provided by
2424 Subchapters B, C, D, E, and J, Chapter 39;
2525 (C) extracurricular activities under Section
2626 33.081 or participation in a University Interscholastic League
2727 area, regional, or state competition under Section 33.0812;
2828 (D) health and safety under Chapter 38;
2929 (E) purchasing under Subchapter B, Chapter 44;
3030 (F) elementary school class size limits, except
3131 as provided by Section 25.112;
3232 (G) removal of a disruptive student from the
3333 classroom under Subchapter A, Chapter 37;
3434 (H) at-risk programs under Subchapter C, Chapter
3535 29;
3636 (I) prekindergarten programs under Subchapter E,
3737 Chapter 29;
3838 (J) educator rights and benefits under
3939 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
4040 A, Chapter 22;
4141 (K) special education programs under Subchapter
4242 A, Chapter 29;
4343 (L) bilingual education programs under
4444 Subchapter B, Chapter 29; [or]
4545 (M) the requirements for the first day of
4646 instruction under Section 25.0811; or
4747 (N) assignment of a student to a teacher under
4848 Section 28.0215, except as provided by Subsection (e) of that
4949 section.
5050 SECTION 2. Subchapter B, Chapter 28, Education Code, is
5151 amended by adding Section 28.0215 to read as follows:
5252 Sec. 28.0215. REQUIREMENTS FOR ASSIGNMENT OF STUDENTS TO
5353 TEACHERS. (a) This section applies only to a school district with
5454 an enrollment of 5,000 or more students.
5555 (b) A student in first through grade six who attends an
5656 elementary school may not be assigned for two consecutive school
5757 years to a teacher who:
5858 (1) has less than one year of teaching experience; or
5959 (2) does not hold the appropriate certificate required
6060 under Section 21.003.
6161 (c) The requirement imposed by Subsection (b) does not apply
6262 if the student's parent or other person standing in parental
6363 relation to the student and a school counselor or school
6464 administrator agree otherwise regarding assignment of the student
6565 to a teacher.
6666 (d) Subsection (b) does not apply to the first year a
6767 student transfers into a school district.
6868 (e) Subsection (b) does not apply to teachers teaching
6969 outside of the foundation curriculum stated in Section 28.002(1).
7070 (f) The commissioner may grant a waiver from the
7171 requirements of this section to a school district if the
7272 commissioner finds that extreme circumstances in the district
7373 warrant the waiver. The commissioner may adopt rules as necessary
7474 to implement this section.
7575 SECTION 3. This Act applies beginning with the 2015-2016
7676 school year.
7777 SECTION 4. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2015.
