21	4		AN ACT
22	5		relating to the composition, governance, and authority of a
23	6		regional tollway authority that has or proposes to have projects
24	7		located in counties that are not part of the authority.
25	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
26	9		SECTION 1. Section 366.031, Transportation Code, is amended
27	10		by adding Subsection (e) to read as follows:
28	11		(e) A county that is not part of an authority and in which an
29	12		authority turnpike project is located becomes part of the authority
30	13		on the date the authority determines that:
31	14		(1) recorded electronic toll collections at toll
32	15		assessment facilities located in the county account for not less
33	16		than four percent of all recorded electronic toll collections on
34	17		all of the authority's turnpike projects; and
35	18		(2) the population of the county is at least four
36	19		percent of the aggregate population of all the counties of the
37	20		authority, not including the county that will become part of the
38	21		authority.
39	22		SECTION 2. Subchapter B, Chapter 366, Transportation Code,
40	23		is amended by adding Section 366.0311 to read as follows:
41	24		Sec. 366.0311. ADVISORY COMMITTEE FOR PROJECTS LOCATED
42	25		OUTSIDE AUTHORITY. (a) At the time an authority enters into a
43	26		primary construction contract for its first project to be located
44	27		in a county that is not part of the authority, the authority shall
45	28		create an advisory committee to advise the board on matters related
46	29		to projects located in counties that are not part of the authority.
47	30		(b) The advisory committee must be composed of:
48	31		(1) the director of the authority appointed by the
49	32		governor, who serves as the chair of the committee;
50	33		(2) an additional director of the authority appointed
51	34		by the presiding officer of the board as the presiding officer deems
52	35		appropriate; and
53	36		(3) one member from each county that is not part of the
54	37		authority and in which a project is proposed to be located, to be
55	38		appointed by the commissioners court of that county at the time a
56	39		primary construction contract for the project is entered into.
57	40		(c) An advisory committee member appointed under Subsection
58	41		(b)(3) is not a director of the authority for the purposes of
59	42		Section 366.251 or any other purpose.
60	43		(d) The board may adopt rules governing the operation and
61	44		duties of an advisory committee.
62	45		SECTION 3. Section 366.161, Transportation Code, is amended
63	46		to read as follows:
64	47		Sec. 366.161. TURNPIKE PROJECTS EXTENDING INTO OTHER
65	48		COUNTIES. An authority may acquire, construct, operate, maintain,
66	49		expand, or extend a turnpike project in:
67	50		(1) a county that is a part of the authority; or
68	51		(2) subject to Sections 366.031(e) and 366.0311, a
69	52		county in which the authority operates or is constructing a
70	53		turnpike project if the turnpike project in the affected county is a
71	54		continuation of the authority's turnpike project or system
72	55		extending from an adjacent county.
73	56		SECTION 4. Section 366.251(c), Transportation Code, is
74	57		amended to read as follows:
75	58		(c) In addition to directors appointed by a commissioners
76	59		court under Subsection (b), the commissioners courts of each county
77	60		that created the authority under Section 366.031 [of the authority]
78	61		shall appoint one additional director [if the county is:
79	62		[(1) a county that created the authority under Section
80	63		366.031; or
81	64		[(2) a county in which all or part of a turnpike
82	65		project of not less than 10 centerline miles in length is located
83	66		and has been open for use by the traveling public for at least three
84	67		years].
85	68		SECTION 5. This Act takes effect September 1, 2015.
