| 6 | 6 | | relating to the eligibility to serve as a member of the board of |

| 7 | 7 | | trustees of the Texas County and District Retirement System. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 845.003, Government Code, is amended by |
|---|
| 10 | 10 | | amending Subsections (a) and (b) and adding Subsections (a-1) and |
|---|
| 11 | 11 | | (a-2) to read as follows: |
|---|
| 12 | 12 | | (a) Except as provided by Subsections (a-1) and (a-2), to |
|---|
| 13 | 13 | | [To] be eligible to serve as a trustee a person must be: |
|---|
| 14 | 14 | | (1) a member of the retirement system and an employee |
|---|
| 15 | 15 | | of a participating subdivision; [or] and |
|---|
| 16 | 16 | | (2) [a retiree of the retirement system.]a member of a |
|---|
| 17 | 17 | | county commissioners court of a participating subdivision. |
|---|
| 18 | 18 | | (a-1) The eligibility requirements under Subsection (a) |
|---|
| 19 | 19 | | apply only to six members of the board of trustees. The remaining |
|---|
| 20 | 20 | | three members must be representatives of the public. |
|---|
| 21 | 21 | | (a-2) To be eligible as a representative of the public |
|---|
| 22 | 22 | | required under subsection (a) a person must be: |
|---|
| 23 | 23 | | (1) a person who has not served in elected office; and |
|---|
| 24 | 24 | | (2) a person who has not been employed by a government |
|---|
| 25 | 25 | | entity. |
|---|
| 26 | 26 | | (b) If a person serving as a trustee ceases to meet an |
|---|
| 27 | 27 | | eligibility requirement under this section [Subsection (a)], the |
|---|
| 28 | 28 | | person shall vacate the office of trustee. |
|---|
| 29 | 29 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 30 | 30 | | 845.003, Government Code, regarding the eligibility requirements |
|---|
| 31 | 31 | | of members of the board of trustees of the Texas County and District |
|---|
| 32 | 32 | | Retirement System, does not affect the entitlement of a member |
|---|
| 33 | 33 | | serving on the board immediately before the effective date of this |
|---|
| 34 | 34 | | Act to continue to serve as a member of the board for the remainder |
|---|
| 35 | 35 | | of the member's term. As the terms of board members expire or as a |
|---|
| 36 | 36 | | vacancy occurs on the board, the governor shall appoint a member to |
|---|
| 37 | 37 | | the board as necessary to comply with Section 845.003(a-1) and |
|---|
| 38 | 38 | | (a-2), Government Code, as added by this Act. |

| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2015. |
