44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the eligibility to serve as a member of the board of
77 trustees of the Texas County and District Retirement System.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 845.003, Government Code, is amended by
1010 amending Subsections (a) and (b) and adding Subsections (a-1) and
1111 (a-2) to read as follows:
1212 (a) Except as provided by Subsections (a-1) and (a-2), to
1313 [To] be eligible to serve as a trustee a person must be:
1414 (1) a member of the retirement system and an employee
1515 of a participating subdivision; [or] and
1616 (2) [a retiree of the retirement system.]a member of a
1717 county commissioners court of a participating subdivision.
1818 (a-1) The eligibility requirements under Subsection (a)
1919 apply only to six members of the board of trustees. The remaining
2020 three members must be representatives of the public.
2121 (a-2) To be eligible as a representative of the public
2222 required under subsection (a) a person must be:
2323 (1) a person who has not served in elected office; and
2424 (2) a person who has not been employed by a government
2525 entity.
2626 (b) If a person serving as a trustee ceases to meet an
2727 eligibility requirement under this section [Subsection (a)], the
2828 person shall vacate the office of trustee.
2929 SECTION 2. The change in law made by this Act to Section
3030 845.003, Government Code, regarding the eligibility requirements
3131 of members of the board of trustees of the Texas County and District
3232 Retirement System, does not affect the entitlement of a member
3333 serving on the board immediately before the effective date of this
3434 Act to continue to serve as a member of the board for the remainder
3535 of the member's term. As the terms of board members expire or as a
3636 vacancy occurs on the board, the governor shall appoint a member to
3737 the board as necessary to comply with Section 845.003(a-1) and
3838 (a-2), Government Code, as added by this Act.
3939 SECTION 3. This Act takes effect September 1, 2015.
