66 AN ACT
77 relating to the comparison of any list of the legal status of
88 certain persons who are not citizens to the list of registered
99 voters.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 18, Election Code, is
1212 amended by adding Section 18.062 to read as follows:
1313 Sec. 18.062. INFORMATION REGARDING DEFERRED DEPORTATIONS.
1414 The secretary of state may obtain, from any agency or authority of
1515 this state with which the information is shared, information
1616 obtained from an agency or authority of the federal government
1717 relating to persons who, through an executive order or other means,
1818 have been given deferrals from deportation or amnesty from
1919 penalties imposed under any federal immigration statute.
2020 SECTION 2. Section 18.068, Election Code, is amended by
2121 amending Subsection (a) and adding Subsection (g) to read as
2222 follows:
2323 (a) The secretary of state shall quarterly compare the
2424 information received under Sections [Section] 16.001 and 18.062 of
2525 this code and Section 62.113, Government Code, to the statewide
2626 computerized voter registration list. If the secretary determines
2727 that a voter on the registration list is deceased or has been
2828 excused or disqualified from jury service or given deferrals from
2929 deportation or amnesty from penalties imposed under any federal
3030 immigration statute because the voter is not a citizen, the
3131 secretary shall send notice of the determination to the voter
3232 registrar of the counties considered appropriate by the secretary.
3333 (g) The secretary of state shall inform the county of the
3434 voter's residence if the secretary has determined based on
3535 information the secretary receives under Section 18.062 that a
3636 strong match or weak match exists between identifying information
3737 maintained regarding a county voter and identifying information
3838 regarding an individual who has been given deferrals from
3939 deportation or amnesty from penalties imposed under any federal
4040 immigration statute. On receiving notification from the secretary
4141 of state that a strong match or weak match of identifying
4242 information exists, the county shall investigate whether the voter
4343 is the individual about whom information is obtained.
4444 SECTION 3. This Act takes effect September 1, 2015.
