99 AN ACT
1010 relating to the regulation of the practice of dental hygiene.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 258.001, Occupations Code, is amended to
1313 read as follows:
1414 Sec. 258.001. [IMPERMISSIBLE] DELEGATIONS. (a) A dentist
1515 may not delegate:
1616 (1) an act to an individual who, by board order, is
1717 prohibited from performing the act;
1818 (2) any of the following acts to a person not licensed
1919 as a dentist or dental hygienist:
2020 (A) the removal of calculus, deposits, or
2121 accretions from the natural and restored surfaces of exposed human
2222 teeth and restorations in the human mouth;
2323 (B) root planing or the smoothing and polishing
2424 of roughened root surfaces or exposed human teeth; or
2525 (C) any other act the delegation of which is
2626 prohibited by board rule; or
2727 (3) any of the following acts to a person not licensed
2828 as a dentist:
2929 (A) comprehensive examination or diagnosis and
3030 treatment planning;
3131 (B) a surgical or cutting procedure on hard or
3232 soft tissue;
3333 (C) the prescription of a drug, medication, or
3434 work authorization;
3535 (D) the taking of an impression for a final
3636 restoration, appliance, or prosthesis;
3737 (E) the making of an intraoral occlusal
3838 adjustment;
3939 (F) direct pulp capping, pulpotomy, or any other
4040 endodontic procedure;
4141 (G) the final placement and intraoral adjustment
4242 of a fixed or removable appliance; or
4343 (H) the placement of any final restoration.
4444 (b) A dentist may delegate[; or
4545 [(4)] the authority to an individual to administer a
4646 local anesthetic agent, inhalation sedative agent, parenteral
4747 sedative agent, or general anesthetic agent if the individual is
4848 [not] licensed as:
4949 (1) [(A)] a dentist, with a permit issued by the board
5050 for the procedure being performed[,] if a permit is required;
5151 (2) [(B)] a certified registered nurse anesthetist
5252 licensed by the Texas Board of Nursing, only if the delegating
5353 dentist holds a permit issued by the board for the procedure being
5454 performed[,] if a permit is required; [or]
5555 (3) [(C)] a physician anesthesiologist licensed by the
5656 Texas Medical Board; or
5757 (4) a dental hygienist, only if:
5858 (A) the procedure is the administration of a
5959 local anesthetic agent under Section 262.002(a)(6);
6060 (B) the dental hygienist has passed a
6161 certification examination approved by the board; and
6262 (C) the dental hygienist:
6363 (i) has completed a course approved by the
6464 board to train dental hygienists to administer local anesthetic
6565 agents; or
6666 (ii) has been licensed in good standing
6767 within the past year to administer local anesthetic agents:
6868 (a) by a branch of the United States
6969 armed forces; or
7070 (b) by another state.
7171 SECTION 2. Section 262.002, Occupations Code, is amended by
7272 amending Subsection (a) and adding Subsection (c) to read as
7373 follows:
7474 (a) A person practices dental hygiene if the person:
7575 (1) removes accumulated matter, tartar, deposits,
7676 accretions, or stains, other than mottled enamel stains, from the
7777 natural and restored surface of exposed human teeth and
7878 restorations in the human mouth;
7979 (2) smoothes roughened root surfaces;
8080 (3) polishes exposed human teeth, restorations in the
8181 human mouth, or roughened root surfaces;
8282 (4) topically applies drugs to the surface tissues of
8383 the human mouth or the exposed surface of human teeth;
8484 (5) makes dental x-rays; [and]
8585 (6) administers intraoral block or infiltration
8686 anesthesia under the authorization and direct supervision of a
8787 dentist; and
8888 (7) performs any other service, task, or procedure
8989 prescribed by board rule.
9090 (c) A dental hygienist may not establish an independent
9191 practice to provide services authorized by this subtitle.
9292 SECTION 3. (a) The State Board of Dental Examiners, not
9393 later than January 1, 2016, shall:
9494 (1) prescribe by rule the requirements for a course to
9595 train dental hygienists to administer local anesthetic agents; and
9696 (2) develop a procedure for the approval of courses
9797 described by Subdivision (1) of this subsection.
9898 (b) A rule adopted under Subsection (a) of this section must
9999 require that a course is:
100100 (1) accredited by the Commission on Dental
101101 Accreditation of the American Dental Association; and
102102 (2) offered in a classroom setting at an educational
103103 institution.
104104 SECTION 4. This Act takes effect September 1, 2015.
