55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of a wireless communication device while
88 operating a motor vehicle; creating an offense and providing
99 penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 545.001, Transportation Code, is amended
1212 by adding Subdivisions (3) and (4) to read as follows:
1313 (3) "Hands-free device" means speakerphone capability
1414 or a telephone attachment or other piece of equipment, regardless
1515 of whether permanently installed in the motor vehicle, that allows
1616 use of the wireless communication device without use of either of
1717 the operator's hands.
1818 (4) "Wireless communication device" means a device
1919 that uses a commercial mobile service, as defined by 47 U.S.C.
2020 Section 332.
2121 SECTION 2. The heading to Section 545.425, Transportation
2222 Code, is amended to read as follows:
2323 Sec. 545.425. USE OF WIRELESS COMMUNICATION DEVICE WHILE
2424 OPERATING MOTOR VEHICLE ON SCHOOL PROPERTY OR IN [A] SCHOOL
2525 CROSSING ZONE [OR WHILE OPERATING A SCHOOL BUS WITH A MINOR
2626 PASSENGER]; OFFENSE.
2727 SECTION 3. Sections 545.425(a), (b), (b-1), (c), (d), and
2828 (f), Transportation Code, are amended to read as follows:
2929 (a) An operator may not use a wireless communication device
3030 while operating a motor vehicle on the property of a public
3131 elementary, middle, junior high, or high school for which a local
3232 authority has designated a school crossing zone, during the time a
3333 reduced speed limit is in effect for the school crossing zone,
3434 unless:
3535 (1) the vehicle's transmission is in park;
3636 (2) the vehicle's parking brake is applied; or
3737 (3) the operator uses the wireless communication
3838 device with a hands-free device [In this section:
3939 [(1) "Hands-free device" means speakerphone
4040 capability or a telephone attachment or other piece of equipment,
4141 regardless of whether permanently installed in the motor vehicle,
4242 that allows use of the wireless communication device without use of
4343 either of the operator's hands.
4444 [(2) "Wireless communication device" means a device
4545 that uses a commercial mobile service, as defined by 47 U.S.C.
4646 Section 332].
4747 (b) An [Except as provided by Subsection (c), an] operator
4848 may not use a wireless communication device while operating a motor
4949 vehicle in [within] a school crossing zone[, as defined by Section
5050 541.302, Transportation Code,] unless:
5151 (1) the vehicle's transmission is in park;
5252 (2) the vehicle's parking brake is applied [vehicle is
5353 stopped]; or
5454 (3) [(2)] the operator uses the wireless
5555 communication device [is used] with a hands-free device.
5656 (b-1) Except as provided by Subsection (b-2), a
5757 municipality, county, or other political subdivision that enforces
5858 Subsection (b) [this section] shall post a sign that complies with
5959 the standards described by this subsection at the entrance to each
6060 school crossing zone in the municipality, county, or other
6161 political subdivision. The department shall adopt standards that:
6262 (1) allow for a sign required to be posted under this
6363 subsection to be attached to an existing sign at a minimal cost; and
6464 (2) require that a sign required to be posted under
6565 this subsection inform an operator that:
6666 (A) the use of a wireless communication device is
6767 prohibited in the school crossing zone; and
6868 (B) the operator is subject to a fine if the
6969 operator uses a wireless communication device in the school
7070 crossing zone.
7171 (c) An offense under this section is a misdemeanor
7272 punishable by a fine of not less than $125 or more than $200
7373 [operator may not use a wireless communication device while
7474 operating a passenger bus with a minor passenger on the bus unless
7575 the passenger bus is stopped].
7676 (d) It is an affirmative defense to prosecution of an
7777 offense [under this section that]:
7878 (1) under this section that the wireless communication
7979 device was used to make an emergency call to:
8080 (A) an emergency response service, including a
8181 rescue, emergency medical, or hazardous material response service;
8282 (B) a hospital;
8383 (C) a fire department;
8484 (D) a health clinic;
8585 (E) a medical doctor's office;
8686 (F) an individual to administer first aid
8787 treatment; or
8888 (G) a law enforcement agency [police
8989 department]; and [or]
9090 (2) under Subsection (b) that a sign required by
9191 Subsection (b-1) was not posted at the entrance to the school
9292 crossing zone at the time of an offense committed in the school
9393 crossing zone.
9494 (f) This [Except as provided by Subsection (b-2), this]
9595 section does not preempt a [preempts all] local ordinance, rule, or
9696 regulation [ordinances, rules, or regulations that are
9797 inconsistent with specific provisions of this section] adopted by a
9898 political subdivision [of this state] relating to the use of a
9999 wireless communication device by the operator of a motor vehicle
100100 that is consistent with or more stringent than the provisions of
101101 this section.
102102 SECTION 4. Subchapter I, Chapter 545, Transportation Code,
103103 is amended by adding Section 545.4251 to read as follows:
104104 Sec. 545.4251. GENERAL USE OF WIRELESS COMMUNICATION DEVICE
105105 WHILE OPERATING MOTOR VEHICLE; OFFENSE. (a) An operator may not use
106106 a wireless communication device while operating a motor vehicle
107107 unless:
108108 (1) the vehicle's transmission is in park;
109109 (2) the vehicle's parking brake is applied; or
110110 (3) the operator uses the wireless communication
111111 device:
112112 (A) with a hands-free device;
113113 (B) for voice communication, including for
114114 reading, selecting, or entering a number or name for the purposes of
115115 making a voice call; or
116116 (C) for navigation.
117117 (b) An offense under this section is a misdemeanor
118118 punishable by a fine of not less than $25 or more than $100.
119119 (c) This section does not apply to:
120120 (1) an operator of an authorized emergency vehicle
121121 using a wireless communication device while acting in an official
122122 capacity; or
123123 (2) an operator who is licensed by the Federal
124124 Communications Commission while operating a radio frequency device
125125 other than a wireless communication device.
126126 (d) This section does not preempt a local ordinance, rule,
127127 or regulation adopted by a political subdivision relating to the
128128 use of a wireless communication device by the operator of a motor
129129 vehicle that is consistent with or more stringent than the
130130 provisions of this section.
131131 SECTION 5. Subchapter I, Chapter 545, Transportation Code,
132132 is amended by adding Section 545.4261 to read as follows:
133133 Sec. 545.4261. USE OF WIRELESS COMMUNICATION DEVICE WHILE
134134 OPERATING PASSENGER BUS WITH MINOR PASSENGER; OFFENSE. (a) An
135135 operator may not use a wireless communication device while
136136 operating a passenger bus with a passenger under 18 years of age on
137137 the bus unless:
138138 (1) the transmission of the bus is in park; or
139139 (2) the parking brake of the bus is applied.
140140 (b) It is an affirmative defense to prosecution of an
141141 offense under this section that the wireless communication device
142142 was used to make an emergency call to:
143143 (1) an emergency response service, including a rescue,
144144 emergency medical, or hazardous material response service;
145145 (2) a hospital;
146146 (3) a fire department;
147147 (4) a health clinic;
148148 (5) a medical doctor's office;
149149 (6) an individual to administer first aid treatment;
150150 or
151151 (7) a law enforcement agency.
152152 (c) This section does not apply to an operator who is
153153 licensed by the Federal Communications Commission while operating a
154154 radio frequency device other than a wireless communication device.
155155 (d) This section does not preempt a local ordinance, rule,
156156 or regulation adopted by a political subdivision relating to the
157157 use of a wireless communication device by the operator of a motor
158158 vehicle that is consistent with or more stringent than the
159159 provisions of this section.
160160 SECTION 6. Sections 545.424(f) and 545.4252,
161161 Transportation Code, are repealed.
162162 SECTION 7. The change in law made by this Act applies only
163163 to an offense committed on or after the effective date of this Act.
164164 An offense committed before the effective date of this Act is
165165 governed by the law in effect on the date the offense was committed,
166166 and the former law is continued in effect for that purpose. For
167167 purposes of this section, an offense was committed before the
168168 effective date of this Act if any element of the offense occurred
169169 before that date.
170170 SECTION 8. This Act takes effect September 1, 2015.
