55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the practice of therapeutic optometry.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 351.002(7), Occupations Code, is amended
1010 to read as follows:
1111 (7) "Practice of therapeutic optometry" means using
1212 objective or subjective means, [not] including surgery except as
1313 prohibited under Section 351.4521 [or laser surgery], to:
1414 (A) determine or measure the powers of vision of
1515 the human eye as provided by Section 351.355;
1616 (B) examine or diagnose visual defects, abnormal
1717 conditions, or diseases of the human eye or adnexa;
1818 (C) prescribe or fit lenses or prisms to correct
1919 or remedy a defect or abnormal condition of vision as provided by
2020 Section 351.356;
2121 (D) administer or prescribe a drug or physical
2222 treatment in the manner authorized by this chapter; or
2323 (E) treat the visual system, including the eye or
2424 adnexa as authorized by this chapter.
2525 SECTION 2. Sections 351.358(b) and (c), Occupations Code,
2626 are amended to read as follows:
2727 (b) A therapeutic optometrist may:
2828 (1) administer, perform, or prescribe ophthalmic
2929 devices, procedures, and appropriate medications administered by
3030 topical, subconjunctival, or oral means[, in accordance with this
3131 section and Section 351.3581,] to diagnose or treat visual defects,
3232 abnormal conditions, or diseases of the human vision system,
3333 including the eye and adnexa; or
3434 (2) administer medication by parenteral means for a
3535 purpose and in a manner prescribed by Subsection (e).
3636 (c) A therapeutic optometrist may administer or prescribe
3737 oral analgesic medications only in the following classifications of
3838 oral pharmaceuticals:
3939 (1) [one 10-day supply of oral antibiotics;
4040 [(2) one 72-hour supply of oral antihistamines;
4141 [(3) one seven-day supply of oral nonsteroidal
4242 anti-inflammatories;
4343 [(4)] one three-day supply of any analgesic medication
4444 classified as a controlled substance under Schedule [identified in
4545 Schedules] III, IV, or [and] V of 21 U.S.C. Section 812; and
4646 (2) one three-day supply of hydrocodone or of a
4747 hydrocodone combination medication classified as a controlled
4848 substance under Schedule II of 21 U.S.C. Section 812
4949 [(5) any other oral pharmaceutical recommended by the
5050 Optometric Health Care Advisory Committee and approved by the board
5151 and the Texas State Board of Medical Examiners].
5252 SECTION 3. The heading to Section 351.3581, Occupations
5353 Code, is amended to read as follows:
5454 Sec. 351.3581. [DIAGNOSIS AND] TREATMENT OF GLAUCOMA.
5555 SECTION 4. Section 351.3581(a), Occupations Code, is
5656 amended to read as follows:
5757 (a) A therapeutic optometrist may not administer or
5858 prescribe an oral or parenteral medication or treat glaucoma unless
5959 the therapeutic optometrist holds a certificate issued by the
6060 board. A therapeutic optometrist certified under this section
6161 [subsection] shall be known as an optometric glaucoma specialist.
6262 To obtain a certificate, a therapeutic optometrist must [as
6363 required under Section 351.165(c)]:
6464 (1) complete an instructional clinical review course;
6565 and
6666 (2) pass an examination approved by the board.
6767 SECTION 5. Section 351.4521, Occupations Code, is amended
6868 to read as follows:
6969 Sec. 351.4521. PERFORMANCE OF CERTAIN SURGICAL PROCEDURES
7070 BY THERAPEUTIC OPTOMETRISTS [SURGERY] PROHIBITED. (a) A
7171 therapeutic optometrist may not perform the following surgical
7272 procedures:
7373 (1) retinal laser procedures, laser-assisted in situ
7474 keratomileusis (LASIK), photorefractive keratectomy (PRK), or
7575 laser epithelial keratomileusis (LASEK);
7676 (2) penetrating keratoplasty, corneal transplant, or
7777 lamellar keratoplasty;
7878 (3) a surgical procedure that requires the
7979 administration of general anesthesia;
8080 (4) intraocular injection;
8181 (5) a surgical procedure relating to the removal of
8282 the eye from a living person;
8383 (6) a surgical procedure requiring full-thickness
8484 incision or excision of the cornea or sclera other than
8585 paracentesis in an emergency situation requiring immediate
8686 reduction of the pressure inside of the eye;
8787 (7) a surgical procedure requiring incision or
8888 excision of the iris and ciliary body, including iris diathermy and
8989 cryotherapy;
9090 (8) a surgical procedure requiring incision or
9191 excision of the vitreous;
9292 (9) a surgical procedure requiring incision or
9393 excision of the retina;
9494 (10) surgical extraction of the crystalline lens;
9595 (11) surgical intraocular implants;
9696 (12) incisional or excisional surgery of the
9797 extraocular muscles;
9898 (13) surgery of the eyelid for a suspected eyelid
9999 malignancy;
100100 (14) surgery of the eyelid, including the incisional,
101101 excisional, or mechanical repair of blepharochalasis,
102102 dermatochalasis, or ptosis;
103103 (15) tarsorrhaphy;
104104 (16) surgery of the bony orbit, including orbital
105105 implants;
106106 (17) incisional or excisional surgery of the lacrimal
107107 system other than lacrimal probing and related procedures;
108108 (18) a surgical procedure requiring full-thickness
109109 conjunctivoplasty with graft or flap;
110110 (19) retrobulbar injection or injection into the
111111 extraocular orbital space; and
112112 (20) pterygium surgery [or laser surgery].
113113 (b) This section does not prevent a therapeutic optometrist
114114 from providing preoperative or postoperative care relating to a
115115 surgical procedure listed in Subsection (a).
116116 SECTION 6. The following provisions of the Occupations Code
117117 are repealed:
118118 (1) Section 351.358(d); and
119119 (2) Sections 351.3581(b), (c), (d), (e), (f), (g),
120120 (h), (i), and (j).
121121 SECTION 7. This Act takes effect September 1, 2015.
