12 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 7 | | SECTION 1. Section 614.127, Government Code, is amended to |
---|
14 | 8 | | read as follows: |
---|
15 | 9 | | Sec. 614.127. LOST OR STOLEN CARDS. If an identification |
---|
16 | 10 | | card issued under this subchapter is lost or stolen, the law |
---|
17 | 11 | | enforcement agency or other governmental entity that issued |
---|
18 | 12 | | [issuing] the card to the peace officer, reserve law enforcement |
---|
19 | 13 | | officer, or honorably retired peace officer shall issue a duplicate |
---|
20 | 14 | | identification card to the officer if the [may: |
---|
21 | 15 | | [(1) require a peace officer, reserve law enforcement |
---|
22 | 16 | | officer, or honorably retired peace] officer submits [to submit] an |
---|
23 | 17 | | affidavit executed by the [peace officer, reserve law enforcement |
---|
24 | 18 | | officer, or honorably retired peace] officer to the law enforcement |
---|
25 | 19 | | agency or other governmental entity [issuing the card] stating that |
---|
26 | 20 | | the identification card was lost or stolen[; and |
---|
27 | 21 | | [(2) issue a duplicate identification card to the |
---|
28 | 22 | | peace officer, reserve law enforcement officer, or honorably |

29 | 23 | | retired peace officer]. |

30 | 24 | | SECTION 2. Subchapter H, Chapter 614, Government Code, as |

31 | 25 | | added by Chapter 1187 (H.B. 638), Acts of the 80th Legislature, |
---|
32 | 26 | | Regular Session, 2007, is repealed. |

33 | 27 | | SECTION 3. This Act takes effect September 1, 2015. |
