| 7 | 7 | | relating to the annexation of certain territory by general law |

| 8 | 8 | | municipalities. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 43.028, Local Government Code, is |
|---|
| 11 | 11 | | amended by adding Subsections (g) and (h) to read as follows: |
|---|
| 12 | 12 | | (g) An area of land that would be eligible for annexation |
|---|
| 13 | 13 | | under this section except that the area does not meet the contiguity |
|---|
| 14 | 14 | | requirement of Subsection (a)(2) may be annexed under this section |
|---|
| 15 | 15 | | if a public right-of-way of a road or highway designated by the |
|---|
| 16 | 16 | | municipality exists that: |
|---|
| 17 | 17 | | (1) is located entirely in the extraterritorial |
|---|
| 18 | 18 | | jurisdiction of the municipality; and |
|---|
| 19 | 19 | | (2) when added to the area would cause the area to be |
|---|
| 20 | 20 | | contiguous to the municipality. |
|---|
| 21 | 21 | | (h) Notwithstanding Section 43.054, on annexation of an |
|---|
| 22 | 22 | | area described by Subsection (g), the public right-of-way that |
|---|
| 23 | 23 | | makes the area eligible for annexation under Subsection (g) is |
|---|
| 24 | 24 | | included in the annexation to the municipality without regard to |
|---|
| 25 | 25 | | whether the owners of the public right-of-way sought annexation |
|---|
| 26 | 26 | | under this section. The ordinance providing for annexation must |
|---|
| 27 | 27 | | provide a metes and bounds description of the public right-of-way |
|---|
| 28 | 28 | | annexed under this subsection. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2015. |
|---|
