55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the annexation of certain territory by general law
88 municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.028, Local Government Code, is
1111 amended by adding Subsections (g) and (h) to read as follows:
1212 (g) An area of land that would be eligible for annexation
1313 under this section except that the area does not meet the contiguity
1414 requirement of Subsection (a)(2) may be annexed under this section
1515 if a public right-of-way of a road or highway designated by the
1616 municipality exists that:
1717 (1) is located entirely in the extraterritorial
1818 jurisdiction of the municipality; and
1919 (2) when added to the area would cause the area to be
2020 contiguous to the municipality.
2121 (h) Notwithstanding Section 43.054, on annexation of an
2222 area described by Subsection (g), the public right-of-way that
2323 makes the area eligible for annexation under Subsection (g) is
2424 included in the annexation to the municipality without regard to
2525 whether the owners of the public right-of-way sought annexation
2626 under this section. The ordinance providing for annexation must
2727 provide a metes and bounds description of the public right-of-way
2828 annexed under this subsection.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2015.
