55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of certain counties to contract with a
88 private vendor for the operation of a detention facility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 351.102, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 351.102. ADDITIONAL AUTHORITY TO CONTRACT. The
1313 commissioners court of a county may contract with a private vendor
1414 to provide for the financing, design, construction, leasing,
1515 operation, purchase, maintenance, or management of a jail,
1616 detention center, work camp, or related facility. The commissioners
1717 court may not award a contract under this section unless the
1818 commissioners court requests proposals by public notice and not
1919 less than 30 days from such notice receives a proposal that meets or
2020 exceeds the requirements specified in the request for proposals.
2121 Before the commissioners court of a county enters into a contract
2222 under this section, the commissioners court of the county must
2323 receive the written approval of the sheriff of the county, which
2424 written approval shall not be unreasonably withheld[, or if the
2525 county has a population of 2.8 million or more:
2626 [(1) consult with the sheriff regarding the
2727 feasibility of ensuring that all services provided under the
2828 contract are required to meet or exceed standards set by the
2929 Commission on Jail Standards; or
3030 [(2) receive the written approval of the sheriff of
3131 the county, which written approval shall not be unreasonably
3232 withheld].
3333 SECTION 2. The change in law made by this Act applies only
3434 to a contract entered into on or after the effective date of this
3535 Act. A contract entered into before the effective date of this Act
3636 is governed by the law in effect when the contract was entered into,
3737 and the former law is continued in effect for that purpose.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2015.
