| 7 | 7 | | relating to Medicaid billing for the services of substitute |

| 8 | 8 | | dentists. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 32.076 to read as follows: |
|---|
| 12 | 12 | | Sec. 32.076. SUBSTITUTE DENTISTS. To the extent allowed by |
|---|
| 13 | 13 | | federal law, the executive commissioner of the Health and Human |
|---|
| 14 | 14 | | Services Commission shall adopt rules ensuring that the same |
|---|
| 15 | 15 | | standards applying to a physician who bills the medical assistance |
|---|
| 16 | 16 | | program for services provided by a substitute physician apply also |
|---|
| 17 | 17 | | to a dentist who bills the medical assistance program for services |
|---|
| 18 | 18 | | provided by a substitute dentist. |
|---|
| 19 | 19 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 20 | 20 | | a state agency determines that a waiver or authorization from a |
|---|
| 21 | 21 | | federal agency is necessary for implementation of that provision, |
|---|
| 22 | 22 | | the agency affected by the provision shall request the waiver or |
|---|
| 23 | 23 | | authorization and may delay implementing that provision until the |
|---|
| 24 | 24 | | waiver or authorization is granted. |
|---|
| 25 | 25 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 26 | 26 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 27 | 27 | | Services Commission shall adopt the rules necessary to implement |
|---|
| 28 | 28 | | the changes in law made by this Act. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2015. |
|---|
