55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the assessment of fourth and seventh grade public
88 school students in writing and English language arts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.023(a), Education Code, as effective
1111 until on or before September 1, 2015, is amended to read as follows:
1212 (a) The agency shall adopt or develop appropriate
1313 criterion-referenced assessment instruments designed to assess
1414 essential knowledge and skills in reading, English language arts
1515 [writing], mathematics, social studies, and science. Except as
1616 provided by Subsection (a-2), all students, other than students
1717 assessed under Subsection (b) or (l) or exempted under Section
1818 39.027, shall be assessed in:
1919 (1) mathematics, annually in grades three through
2020 seven without the aid of technology and in grade eight with the aid
2121 of technology on any assessment instrument that includes algebra;
2222 (2) reading, annually in grades three through eight;
2323 (3) English language arts [writing], including
2424 spelling and grammar, in grades four and seven;
2525 (4) social studies, in grade eight;
2626 (5) science, in grades five and eight; and
2727 (6) any other subject and grade required by federal
2828 law.
2929 SECTION 2. Section 39.023(a), Education Code, as effective
3030 on or before September 1, 2015, is amended to read as follows:
3131 (a) The agency shall adopt or develop appropriate
3232 criterion-referenced assessment instruments designed to assess
3333 essential knowledge and skills in reading, English language arts
3434 [writing], mathematics, social studies, and science. Except as
3535 provided by Subsection (a-2), all students, other than students
3636 assessed under Subsection (b) or (l) or exempted under Section
3737 39.027, shall be assessed in:
3838 (1) mathematics, in grades three and five without the
3939 aid of technology and in grade eight with the aid of technology on
4040 any assessment instrument that includes algebra;
4141 (2) reading, in grades three, five, and eight;
4242 (3) English language arts [writing], including
4343 spelling and grammar, in grades four and seven;
4444 (4) social studies, in grade eight; and
4545 (5) science, in grades five and eight.
4646 SECTION 3. Section 39.023(a), Education Code, as effective
4747 September 1, 2017, is amended to read as follows:
4848 (a) The agency shall adopt or develop appropriate
4949 criterion-referenced assessment instruments designed to assess
5050 essential knowledge and skills in reading, English language arts
5151 [writing], mathematics, social studies, and science. Except as
5252 provided by Subsection (a-2), all students, other than students
5353 assessed under Subsection (b) or (l) or exempted under Section
5454 39.027, shall be assessed in:
5555 (1) mathematics, annually in grades three through
5656 seven without the aid of technology and in grade eight with the aid
5757 of technology on any assessment instrument that includes algebra;
5858 (2) reading, annually in grades three through eight;
5959 (3) English language arts [writing], including
6060 spelling and grammar, in grades four and seven;
6161 (4) social studies, in grade eight;
6262 (5) science, in grades five and eight; and
6363 (6) any other subject and grade required by federal
6464 law.
6565 SECTION 4. Section 39.023, Education Code, is amended by
6666 adding Subsection (q) to read as follows:
6767 (q) A writing sample submitted by a student in connection
6868 with an assessment instrument administered under this section,
6969 other than an English I or English II end-of-course assessment
7070 instrument described by Subsection (c), may not be used to assess
7171 the student's writing for purposes of accountability under this
7272 chapter or for purposes of grade promotion criteria. Except as
7373 provided by Subsection (c), the assessment of a student's writing
7474 is governed by Section 39.0264.
7575 SECTION 5. Subchapter B, Chapter 39, Education Code, is
7676 amended by adding Section 39.0264 to read as follows:
7777 Sec. 39.0264. LOCAL ASSESSMENT REQUIRED FOR WRITING IN
7878 CERTAIN GRADES. (a) To evaluate student achievement in writing,
7979 each school district shall assess students in grades four and seven
8080 in accordance with the essential knowledge and skills for writing.
8181 A district may use any method the district determines appropriate
8282 for assessing students under this section, including portfolio
8383 assessment.
8484 (b) School districts shall report to the agency, as
8585 determined by agency rule, the results of assessments required
8686 under this section.
8787 (c) The results of assessments required under this section
8888 may not be used for purposes of accountability under this chapter or
8989 for purposes of grade promotion criteria.
9090 SECTION 6. Not later than September 1, 2016, the Texas
9191 Education Agency shall adopt or develop appropriate
9292 criterion-referenced assessment instruments designed to assess
9393 essential knowledge and skills in English language arts as required
9494 by Section 39.023, Education Code, as amended by this Act.
9595 SECTION 7. This Act applies beginning with the 2016-2017
9696 school year.
9797 SECTION 8. This Act takes effect immediately if it receives
9898 a vote of two-thirds of all the members elected to each house, as
9999 provided by Section 39, Article III, Texas Constitution. If this
100100 Act does not receive the vote necessary for immediate effect, this
101101 Act takes effect September 1, 2015.
