55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirement that a parent appointed as a
88 conservator of a child disclose certain information regarding
99 family violence.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 153.076(b), Family Code, is amended to
1212 read as follows:
1313 (b) The court shall order that each conservator of a child
1414 has the duty to inform the other conservator of the child if the
1515 conservator resides with for at least 30 days, marries, or intends
1616 to marry a person who the conservator knows:
1717 (1) is registered as a sex offender under Chapter 62,
1818 Code of Criminal Procedure; [or]
1919 (2) is currently charged with an offense for which on
2020 conviction the person would be required to register under Chapter
2121 62, Code of Criminal Procedure;
2222 (3) is the subject of a protective order rendered
2323 under Chapter 85 or a similar law of another state in which the
2424 person was found to have committed family violence; or
2525 (4) is currently charged with an offense involving
2626 family violence for which a protective order may be rendered under
2727 Chapter 85 or a similar law of another state [that chapter].
2828 SECTION 2. (a) Except as provided by Subsection (b) of this
2929 section, the changes in law made by this Act to Section 153.076(b),
3030 Family Code, apply only to a court order rendered on or after the
3131 effective date of this Act. A court order rendered before that date
3232 is governed by the law in effect on the date the order was rendered,
3333 and the former law is continued in effect for that purpose.
3434 (b) A person may bring a suit to modify a court order
3535 rendered before September 1, 2015, under Section 153.076(b), Family
3636 Code, as amended by this Act.
3737 SECTION 3. This Act takes effect September 1, 2015.
