88 projects at Texas A&M University-Commerce.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Section 55.1781 to read as follows:
1212 Sec. 55.1781. TEXAS A&M UNIVERSITY-COMMERCE; ADDITIONAL
1313 BONDS. (a) In addition to the other authority granted under this
1414 subchapter, the board of regents of The Texas A&M University System
1515 may acquire, purchase, construct, improve, renovate, enlarge, or
1616 equip property and facilities, including roads and related
1717 infrastructure, for Texas A&M University-Commerce for the
1818 following projects to be financed by the issuance of bonds in
1919 accordance with a systemwide revenue financing program and secured
2020 as provided by that program, in aggregate principal amounts not to
2121 exceed:
2222 (1) $54 million for a nursing and health sciences
2323 building; and
2424 (2) $54 million for a library and center for
2525 educational innovation and faculty development.
2626 (b) The board may pledge irrevocably to the payment of the
2727 bonds authorized by this section all or any part of the revenue
2828 funds of an institution, branch, or entity of The Texas A&M
2929 University System, including student tuition charges. The amount
3030 of a pledge made under this subsection may not be reduced or
3131 abrogated while the bonds for which the pledge is made, or bonds
3232 issued to refund those bonds, are outstanding.
3333 (c) If sufficient funds are not available to the board to
3434 meet its obligations under this section, the board may transfer
3535 funds among institutions, branches, and entities of The Texas A&M
3636 University System to ensure the most equitable and efficient
3737 allocation of available resources for each institution, branch, or
3838 entity to carry out its duties and purposes.
3939 SECTION 2. This Act does not affect any authority or
4040 restriction regarding the activities that a public institution of
4141 higher education may conduct in connection with a facility financed
4242 by bonds authorized by this Act.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2015.
