88 AN ACT
99 relating to the issuance of school district teaching permits to
1010 persons who teach career and technology education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 21.055, Education Code, is amended by
1313 amending Subsections (a), (b), and (e) and adding Subsections
1414 (d-1), (d-2), and (d-3) to read as follows:
1515 (a) As provided by this section, a school district or school
1616 district board of trustees may issue a school district teaching
1717 permit and employ as a teacher a person who does not hold a teaching
1818 certificate issued by the board.
1919 (b) To be eligible for a school district teaching permit
2020 under this section, a person must hold a baccalaureate degree.
2121 [This subsection does not apply to a person who will teach only
2222 career and technology education.]
2323 (d-1) Subsections (b), (c), and (d) do not apply to a person
2424 who will teach only courses in career and technology education. A
2525 school district board of trustees may issue a school district
2626 teaching permit to a person who will teach only courses in career
2727 and technology education if:
2828 (1) the superintendent of the district certifies to
2929 the board of trustees that the person:
3030 (A) is qualified to teach the subject matter,
3131 based on the person's demonstrated expertise obtained through
3232 professional work experience, formal training and education, or a
3333 combination of experience, training, and education;
3434 (B) is capable of proper classroom management;
3535 and
3636 (C) has been the subject of a criminal history
3737 record information review under Subchapter C, Chapter 22; and
3838 (2) the person is required to:
3939 (A) obtain at least 30 hours of classroom
4040 management training, including courses that contain curriculum
4141 regarding professional practices and responsibilities and the code
4242 of ethics and standard practices for educators in this state that is
4343 comparable to the curriculum regarding those topics that is
4444 required to be included in educator preparation curriculum under
4545 rules of the State Board for Educator Certification; and
4646 (B) comply with continuing education
4747 requirements as determined by the board of trustees.
4848 (d-2) A person who receives a school district teaching
4949 permit under Subsection (d-1) may teach the subject matter
5050 described in the permit immediately on issuance of the permit.
5151 (d-3) Promptly after employing a person under a school
5252 district teaching permit under Subsection (d-1), the school
5353 district board of trustees shall send to the commissioner a written
5454 statement that identifies the person, specifies the course or
5555 courses that the person will teach, and describes the person's
5656 qualifications to teach the course or courses.
5757 (e) A person authorized to teach under this section may not
5858 teach in another school district unless that district or the board
5959 of trustees for that district complies with this section. A school
6060 district teaching permit remains valid unless the district or board
6161 of trustees issuing the permit revokes it for cause.
6262 SECTION 2. This Act applies beginning with the 2015-2016
6363 school year.
6464 SECTION 3. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2015.
