66 AN ACT
77 relating to a study concerning the presence and effects of plastic
88 microbeads in water in the state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
1111 by adding Section 26.0134 to read as follows:
1212 Sec. 26.0134. STUDY ON EFFECTS OF PLASTIC MICROBEADS IN
1313 WATER. (a) In this section, "plastic microbead" means a
1414 nonbiodegradable solid plastic particle measuring five millimeters
1515 or less in size that is intentionally added to a cosmetic or
1616 personal care product.
1717 (b) The commission shall conduct a study to determine:
1818 (1) the extent of the presence of plastic microbeads
1919 in water in the state; and
2020 (2) whether the presence of plastic microbeads in
2121 water in the state causes pollution of that water.
2222 (c) Not later than December 1, 2016, the commission shall
2323 provide to the governor, the lieutenant governor, and the
2424 legislature a report containing:
2525 (1) the results of the study conducted under this
2626 section; and
2727 (2) if the commission determines that the presence of
2828 plastic microbeads in water in the state causes pollution of that
2929 water, recommendations for reducing or eliminating the pollution,
3030 including consideration of the regulation or ban of plastic
3131 microbeads in cosmetics and other personal care products.
3232 (d) This section expires September 1, 2017.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2015.
