| 7 | 7 | | relating to a study concerning the presence and effects of plastic |

| 8 | 8 | | microbeads in water in the state. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
|---|
| 11 | 11 | | by adding Section 26.0134 to read as follows: |
|---|
| 12 | 12 | | Sec. 26.0134. STUDY ON EFFECTS OF PLASTIC MICROBEADS IN |
|---|
| 13 | 13 | | WATER. (a) In this section, "plastic microbead" means a |
|---|
| 14 | 14 | | nonbiodegradable solid plastic particle measuring five millimeters |
|---|
| 15 | 15 | | or less in size that is intentionally added to a cosmetic or |
|---|
| 16 | 16 | | personal care product. |
|---|
| 17 | 17 | | (b) The commission shall conduct a study to determine: |
|---|
| 18 | 18 | | (1) the extent of the presence of plastic microbeads |
|---|
| 19 | 19 | | in water in the state; and |
|---|
| 20 | 20 | | (2) whether the presence of plastic microbeads in |
|---|
| 21 | 21 | | water in the state causes pollution of that water. |
|---|
| 22 | 22 | | (c) Not later than December 1, 2016, the commission shall |
|---|
| 23 | 23 | | provide to the governor, the lieutenant governor, and the |
|---|
| 24 | 24 | | legislature a report containing: |
|---|
| 25 | 25 | | (1) the results of the study conducted under this |
|---|
| 26 | 26 | | section; and |
|---|
| 27 | 27 | | (2) if the commission determines that the presence of |
|---|
| 28 | 28 | | plastic microbeads in water in the state causes pollution of that |
|---|
| 29 | 29 | | water, recommendations for reducing or eliminating the pollution, |
|---|
| 30 | 30 | | including consideration of the regulation or ban of plastic |
|---|
| 31 | 31 | | microbeads in cosmetics and other personal care products. |
|---|
| 32 | 32 | | (d) This section expires September 1, 2017. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2015. |
