55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the issuance of a license in this state to certain
88 physicians licensed outside of this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The purpose of this Act is to improve health care
1111 in this state by encouraging physicians to relocate to this state
1212 and by providing for the expedited licensing of those physicians.
1313 SECTION 2. Subchapter A, Chapter 155, Occupations Code, is
1414 amended by adding Section 155.010 to read as follows:
1515 Sec. 155.010. LICENSING OF PHYSICIANS WITH CERTAIN
1616 SPECIALTIES; RECIPROCITY. (a) This section applies only to an
1717 applicant who is a physician licensed in a jurisdiction other than
1818 this state and who holds a specialty certification recognized by
1919 the board in one of the following areas:
2020 (1) primary care;
2121 (2) psychiatry;
2222 (3) family practice;
2323 (4) internal medicine;
2424 (5) pediatrics; or
2525 (6) obstetrics and gynecology.
2626 (b) The board shall issue a license to an applicant
2727 described by Subsection (a) who the board determines holds a
2828 license issued by another jurisdiction that has licensing
2929 requirements substantially equivalent to or more stringent than the
3030 requirements of this state.
3131 (c) The board shall issue a license to an applicant who
3232 holds a license issued by a jurisdiction with which this state has a
3333 reciprocity agreement. The board shall enter into an agreement with
3434 another jurisdiction for the issuance of licenses by reciprocity to
3535 applicants described by Subsection (a) if the other jurisdiction
3636 has licensing requirements that are substantially equivalent to or
3737 more stringent than the requirements of this state.
3838 SECTION 3. The change in law made by this Act applies only
3939 to an applicant for a physician license who submits an application
4040 on or after January 1, 2016.
4141 SECTION 4. This Act takes effect September 1, 2015.
