99 relating to the imposition of the student centers fee at Texas
1010 Woman's University.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 54.525, Education Code, is amended by
1313 amending Subsections (a) and (c) and adding Subsection (d) to read
1414 as follows:
1515 (a) The board of regents of Texas Woman's University may
1616 levy a regular, fixed student fee of not less than $25 or more than
1717 $75 [$40] per student for each semester of the long session and of
1818 not less than $12.50 or more than $35 [$20] per student for each
1919 term of the summer session, as the board determines is just and
2020 necessary for the purpose of financing, improving, operating,
2121 maintaining, and equipping student centers and acquiring or
2222 constructing additions to student centers.
2323 (c) Revenue from a fee imposed under this section shall be
2424 deposited to the credit of an account known as the "Texas Woman's
2525 University Student Center Fee Account" under the control of the
2626 university's student fee advisory committee. Annually, the
2727 committee shall submit to the president of the university its
2828 recommendation for any change to the amount of the fee and a
2929 complete and itemized budget for the student center together with a
3030 complete report of all student center activities conducted during
3131 the past year and all expenditures made in connection with those
3232 activities. The president shall submit the budget to the board of
3333 regents as part of the university's institutional budget. The
3434 board of regents may make changes in the budget that the board
3535 determines are necessary [The board shall keep fees collected under
3636 this section in an account apart from the educational and general
3737 funds of the university. The board shall deposit the fees in a
3838 depository bank designated by the board and shall secure the
3939 deposits as required by law].
4040 (d) Notwithstanding Subsection (a), the board may increase
4141 the amount of the fee for a semester or summer session to an amount
4242 that does not exceed $150 if the increase is approved by a majority
4343 vote of those students participating in a general election called
4444 for that purpose. The increased amount under this subsection may
4545 not be charged after the fifth academic year in which the increased
4646 amount is first charged unless, before the end of that academic
4747 year, the institution has issued bonds payable from the fee, in
4848 which event the increased amount may not be charged after the
4949 academic year in which all such bonds, including refunding bonds
5050 for those bonds, have been fully paid.
5151 SECTION 2. The change in law made by this Act applies only
5252 to fees imposed for a semester or term that begins on or after the
5353 effective date of this Act.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2015.
