8	8	AN ACT
9	9	relating to the imposition of the student centers fee at Texas
10	10	Woman's University.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 54.525, Education Code, is amended by
13	13	amending Subsections (a) and (c) and adding Subsection (d) to read
14	14	as follows:
15	15	(a) The board of regents of Texas Woman's University may
16	16	levy a regular, fixed student fee of not less than $25 or more than
17	17	$75 [$40] per student for each semester of the long session and of
18	18	not less than $12.50 or more than $35 [$20] per student for each
19	19	term of the summer session, as the board determines is just and
20	20	necessary for the purpose of financing, improving, operating,
21	21	maintaining, and equipping student centers and acquiring or
22	22	constructing additions to student centers.
23	23	(c) Revenue from a fee imposed under this section shall be
24	24	deposited to the credit of an account known as the "Texas Woman's
25	25	University Student Center Fee Account" under the control of the
26	26	university's student fee advisory committee. Annually, the
27	27	committee shall submit to the president of the university its
28	28	recommendation for any change to the amount of the fee and a
29	29	complete and itemized budget for the student center together with a
30	30	complete report of all student center activities conducted during
31	31	the past year and all expenditures made in connection with those
32	32	activities. The president shall submit the budget to the board of
33	33	regents as part of the university's institutional budget. The
34	34	board of regents may make changes in the budget that the board
35	35	determines are necessary [The board shall keep fees collected under
36	36	this section in an account apart from the educational and general
37	37	funds of the university. The board shall deposit the fees in a
38	38	depository bank designated by the board and shall secure the
39	39	deposits as required by law].
40	40	(d) Notwithstanding Subsection (a), the board may increase
41	41	the amount of the fee for a semester or summer session to an amount
42	42	that does not exceed $150 if the increase is approved by a majority
43	43	vote of those students participating in a general election called
44	44	for that purpose. The increased amount under this subsection may
45	45	not be charged after the fifth academic year in which the increased
46	46	amount is first charged unless, before the end of that academic
47	47	year, the institution has issued bonds payable from the fee, in
48	48	which event the increased amount may not be charged after the
49	49	academic year in which all such bonds, including refunding bonds
50	50	for those bonds, have been fully paid.
51	51	SECTION 2. The change in law made by this Act applies only
52	52	to fees imposed for a semester or term that begins on or after the
53	53	effective date of this Act.
54	54	SECTION 3. This Act takes effect immediately if it receives
55	55	a vote of two-thirds of all the members elected to each house, as
56	56	provided by Section 39, Article III, Texas Constitution. If this
57	57	Act does not receive the vote necessary for immediate effect, this
58	58	Act takes effect September 1, 2015.
